新兴受贿犯罪若干问题研究

【摘要】：受贿犯罪作为职务犯罪的一种主要犯罪类型,也是当前腐败现象的一种基本表现形式,其侵蚀国家肌体、危害政府公信、践踏社会公平、损害公众利益。随着我国社会经济、政治体制改革的不断深入发展,受贿犯罪的手段和表现形式也呈现出多样化。虽然就本质上而言,受贿犯罪本身的特质没有发生变化;但是落实到具体的案件事实上,则呈现出贿赂活动的手法更加狡猾、隐蔽,有的甚至涂着保护色、穿上“合法”的外衣。而传统的行受贿中赤裸裸的“权钱交易”的外在表现已经弱化,其比例在行受贿案件中逐步降低。那么,有必要在新的历史条件下充分认识受贿犯罪的本质特征,抓住具有各种外在表现形式的受贿行为的本质,着力解决对新型受贿犯罪的司法认定问题,以更有力的打击此类犯罪活动。全文除引言和结语共计三部分:第一部分:新型受贿犯罪的概念与特点。这一部分包括以下三个方面的内容:其一,从实践角度出发,总结目前各种新型受贿犯罪的具体表现,总结新型受贿犯罪的概念。实际上,新型受贿犯罪本身不应当理解为一个法律概念,其应是在一个特定历史时期,对具有某一些特定表现形式的受贿犯罪的概括性陈述。所谓的新型,也仅仅是一个阶段性的概念,新型的事物在经过发展、演变之后,也可以转化成传统的事物。据此,笔者认为:新型受贿犯罪是在特定的历史时期,有别于传统受贿犯罪理论表现形式的,具有受贿犯罪本质特征的各类受贿行为的总和;其二,对新型受贿犯罪与传统受贿犯罪从犯罪本质上进行分析对比,界定二者之间的关系。新型受贿犯罪在本质上其与传统的受贿犯罪之间是统一的,新型的受贿犯罪就是受贿犯罪。新型的受贿犯罪与传统的受贿犯罪没有泾渭分明的界限,之所以今天我们称之为新型的受贿犯罪,是因为其在当前的历史时期,具有着传统受贿犯罪所不具备的特殊的表现形式;其三,通过对各种新型受贿犯罪进行分析,提出新型受贿犯罪隐蔽性、长期性、群体性、期权化的特点。第二部分:新型受贿犯罪的表现形式。这一部分是全文的核心部分,通过对新型受贿犯罪的各种外在表现形式的总结提炼,提出了新型受贿犯罪的十一种表现形式,即:交易型受贿、干股型受贿、合作投资型受贿、委托理财型受贿、赌博型受贿、挂名领薪型受贿、实际占用型受贿、特定关系人型受贿、退还、上交型受贿、期权型受贿、其它形式的新型受贿。第三部分:各种新型受贿犯罪的司法认定。这一部分包括以下四个方面的内容:其一,新型受贿犯罪中罪与非罪的界定。新型受贿犯罪由于其自身的特点,决定在认定此类犯罪过程中,要特别注意正确区分具有相同或相似特性的行为之间罪与非罪的界限;其二,新型受贿犯罪中,由于其表现形式、手段的多样性,决定在正确认识新型受贿犯罪的过程中注重把握此罪彼罪的界定;其三,在认识新型受贿犯罪的过程中,要注意识别各种新型受贿犯罪的共犯形态;其四,由于新型受贿犯罪手段行为的特殊性,以及行为目的适法的或然性,因此,在行受贿过程中,可能存在同时侵犯其他刑法所保护的客体的情形存在,故在认识新型受贿犯罪过程中,要注重识别新型受贿犯罪的罪数形态。
[Abstract]:Bribery crime, as one of the main crime types of duty crime, is also a basic form of expression of the current corruption phenomenon. It eroded the state body, endangering the government's public trust, trampling social fairness and damaging the public interests. With the continuous development of the social economy and the reform of the political system in China, the means and forms of bribery crime are also presented. In essence, the nature of the bribery crime itself has not changed; but in fact, in fact, the practice of bribery is more cunning, concealed, even painted with a protective color, and wearing a "legitimate" coat. The external table of the naked "power and money trade" in the traditional bribery. Now it is weakening, and its proportion is gradually reduced in the case of bribery. Then, it is necessary to fully understand the essential characteristics of the bribery crime under the new historical conditions, seize the nature of bribery with various external manifestations, and to solve the judicial recognition of the new bribery crime, so as to fight this kind of crime more forcefully. In addition to the introduction and conclusion, the article is divided into three parts: the first part: the concept and characteristics of the new bribery crime. This part includes the following three aspects: first, from the practical point of view, it summarizes the specific performance of the new type of bribery crime and summarizes the concept of new bribery crime. In fact, the new bribery crime itself should not be understood. As a legal concept, it should be a generality statement of a certain form of bribery crime in a particular historical period. The so-called new type is only a stage concept. The new things can be transformed into traditional things after the development and evolution. Accordingly, the author thinks that the new bribery crime is a new crime. It is different from the traditional bribery crime theory, which is different from the traditional bribery crime, which has the essence of bribery crime. Secondly, it analyzes the relationship between the new bribery crime and the traditional bribery crime from the essence of the crime, and defines the relationship between the two. The new bribery crime is in essence and the traditional one. The new type of bribery crime is the crime of accepting bribes. The new type of bribery crime and the traditional bribery crime have no clear dividing line. The reason why we call it new type of bribery crime today is because in the current historical period, it has a special form of expression that the crime of traditional bribery does not possess. The new bribery crime, due to its own characteristics, decides to pay special attention to the distinction between the crime and the non crime between the behavior of the same or similar characteristics in the process of identifying this kind of crime; secondly, the new crime is new. In the type of bribery crime, because of its form of expression, the diversity of means, it is decided to pay attention to the definition of the crime in the process of correct recognition of the new bribery crime. Thirdly, in the process of recognizing new bribery crime, we should pay attention to the recognition of the form of the accomplice of new type of bribery crime; fourthly, the special behavior of the new bribery crime is special. Therefore, in the course of bribery, there may exist the existence of the object that violated the other criminal law. Therefore, in the process of recognizing new bribery crime, we should pay attention to the recognition of the number of new types of crime of bribery.
