中介机构执业的刑事风险与防范

【摘要】：中介机构的执业,大都需要具备较高的专业知识和完备的技术服务能力,精细化的职业布置对于中介机构的执业而言具有非同一般的意义。但是,在风险社会的时代背景下,每一项具体的社会工作都会伴随相应的社会风险,故而中介机构的执业,在工作细节上难免受制于风险发展的影响。其中具有严重社会危害性的刑事风险,更因其处于中介机构的执业预期外,一旦具有了向实害方向转化的可能性,就不可避免地会对中介机构的发展造成破坏。所以,中介机构在日常的执业过程中,必须要防控刑事风险的发展,在刑事风险萌芽时,就开始进行全方位的规制,以求将其消除于实害化的可能性之前。
[Abstract]:The practice of intermediary institutions mostly needs to have higher professional knowledge and complete technical service ability. The fine professional arrangement is of extraordinary significance for the practice of intermediary organizations. However, under the background of the risk society, every specific social work is accompanied by the corresponding social risks. Therefore, the practice of intermediary organizations is inevitably subject to the influence of risk development in the working details. The criminal risk which has serious social harmfulness, because it is in the intermediary organization's practice expectation, once has the possibility to transform to the actual harm direction, will inevitably cause the destruction to the intermediary organization's development. Therefore, intermediary organizations in the daily practice process, must prevent and control the development of criminal risk, in the beginning of criminal risk germination, the overall regulation, in order to eliminate it before the possibility of actual harm.
