实名制下倒卖车票罪疑难问题研究

【摘要】：随着实名购票制度的施行,传统意义上的倒卖车票行为得到遏制,铁路售票环境在一定程度上得以改善。但由于铁路运输能力有限、供需矛盾紧张,购票系统有漏洞可寻等原因,产生了利用先进技术、系统化操作等一系列的倒卖车票新行为和手段,给铁路售票系统带来了严重干扰,侵害了旅客的合法权益,造成了市场经济秩序的紊乱。此篇论文主要包含五个章节,第一章从火车实名制出发,对火车实名制的发展、倒卖车票罪的法律渊源进行探究;第二章主要对实名制下倒卖车票罪司法定性的争议与困境进行论述;第三章论述实名制下倒卖车票行为的刑事可罚性,对"倒卖"行为进行定性与分析;第四章对倒卖车票行为中的疑难问题展开论述,诸如使用抢票工具抢票囤票、有偿代订购车票、倒卖与侵犯公民身份信息行为的罪数问题等;第五章对倒卖车票罪在立法和司法的完善进行探讨。最终得出结论,实名制下倒卖车票行为依然会给市场经济秩序造成极大损害,但是仍应当坚持罪行法定的原则,既要严惩违法犯罪分子,遏制倒卖车票犯罪行为,也要保障相应权利人的合法利益,促进社会的多元化、有序化发展。
[Abstract]:With the implementation of the system of ticket purchase by real name, the selling of tickets in the traditional sense has been restrained, and the railway ticketing environment has been improved to a certain extent. However, due to the limited capacity of railway transportation, the tension between supply and demand, the loopholes in the ticket purchase system and other reasons, a series of new acts and means of reselling tickets, such as the use of advanced technology and systematic operation, have emerged. It has brought serious interference to railway ticketing system, infringed on the legitimate rights and interests of passengers, and caused the disorder of market economy order. This paper mainly includes five chapters. The first chapter starts from the train real name system, explores the development of the train real name system and the legal origin of the crime of reselling tickets; The second chapter mainly discusses the disputes and difficulties of the judicial nature of the crime of reselling tickets under the real name system, the third chapter discusses the criminal penalty of the ticket sale under the real name system, and makes qualitative and analysis on the "reselling" behavior. The fourth chapter discusses the difficult problems in ticket resale, such as ticket grabbing tools, ticket purchase, ticket purchase on behalf of compensation, the crime of reselling and infringing civil status information, and so on. Chapter five probes into the perfection of legislation and judicature. Finally, it is concluded that the selling of tickets under the real name system will still cause great harm to the order of the market economy, but we should still adhere to the principle of criminal law, we should severely punish criminals who violate the law and curb the crime of reselling tickets. We should also protect the legitimate interests of the relevant rights holders and promote the diversification and orderly development of society.
