【摘要】：犯罪共同说与行为共同说是就共同正犯的本质展开的争论,旨在解决结果归属问题,从而为适用"部分实行全部责任"的原则提供依据。完全犯罪共同说认为共犯是数人共同犯一罪,所以,共犯者相互之间的罪名必须具有同一性(罪名的从属性)。这一观点要么违反责任主义,要么不能妥当处理共同正犯案件。部分犯罪共同说试图既维持罪名的从属性,又妥当处理共同正犯案件,亦即,在逻辑思维的中间阶段维持了罪名的同一性,在最终阶段又承认了罪名的非同一性。其中间阶段的要求,不仅没有实际意义,而且导致一些案件不能得到妥当处理。构成要件的行为共同说放弃罪名的从属性要求,可以正确处理共同正犯案件。国内学者对行为共同说的批评,或多或少建立在误解的基础之上。
[Abstract]:The theory of joint crime and the theory of joint conduct is a dispute about the essence of the joint principal offender, which aims to solve the problem of attribution of the result, thus providing the basis for the application of the principle of "partial implementation of full responsibility". The total common crime theory holds that the accomplice is a joint crime of several persons, so the charges between the accomplices must be identical (the subordinate attribute of the charges). This view is either a violation of responsibilitarianism or a failure to deal properly with a common principal offence. Part of the common crime theory tries to maintain the subordinate nature of the charge and properly handle the joint principal offender case, that is, the identity of the charge is maintained in the middle stage of logical thinking, and the non-identity of the charge is admitted in the final stage. The requirements of intermediate stage are not only of no practical significance, but also lead to some cases can not be properly dealt with. The behavior of the constituent elements can correctly deal with the joint principal offender. Domestic scholars' criticism of common behavior is more or less based on misunderstanding.
