市场创新监管转型的刑事应对策略——以绿色金融体系建设为背景

【摘要】：2016年出台的《关于构建绿色金融体系的指导意见》,为绿色市场创新提供了金融支持。绿色金融体系建设与市场创新之间产生了双向互动模式。通过梳理相关刑事罪名,辨析各理论之争,反对污染环境罪危险犯的理论重构,支持结果犯的理论设定,将与绿色金融相关的传统犯罪行为也纳入刑事司法的保护圈,从而提出以罪刑法定原则为宗旨、以宽严相济刑事政策为灵魂、建立"双轨式"监管机制的刑事应对策略。
[Abstract]:The guiding opinions on the construction of green financial system, promulgated in 2016, provide financial support for green market innovation. There is a two-way interactive model between the green financial system construction and market innovation. By combing the related criminal charges, the argument of various theories is identified, the theoretical reconstruction of the dangerous criminals in the environment of environmental pollution is opposed, and the consequential offense is supported. The theory is set, the traditional crime related to green finance is also included in the protection circle of criminal justice, and the criminal response strategy of "double track" supervision mechanism is set up by taking the principle of legal punishment as the purpose, taking the criminal policy of leniency as the soul and establishing the "double track" supervision mechanism.
