草原生态刑法保护下的企业刑事责任论

【摘要】：当前,我国草原生态系统正处于严重恶化之中。综观各种原因,以草原为主要生产基础的企业在传统人类中心主义理念驱使下,为追求经济效益最大化对草原生态资源掠夺式的开发利用是草原生态环境遭遇破坏的主要原因之一。从我国草原立法保护现状来看,单靠行政、民事及其他社会保障手段已不足以遏制企业对草原生态环境的破坏行为,更于草原生态的恢复效果甚微。刑法的介入对草原生态的保护而言意义重大。针对企业行为对草原生态环境的破坏,刑法介入最合理的方式就是在提升草原生态法益保护理念的基础上完善企业相关刑事责任的规定,进而有效遏制企业破坏草原生态的犯罪行为。具体而言,我国企业在此方面刑事责任的完善应体现在归责原则的重置、刑罚种类的增加与量刑幅度的提升等几方面。
[Abstract]:At present, the grassland ecosystem of our country is in serious deterioration. For various reasons, enterprises based on grasslands are driven by traditional anthropocentrism. The predatory exploitation and utilization of grassland ecological resources in order to maximize economic benefits is one of the main reasons for grassland ecological environment to be destroyed. From the current situation of grassland legislation protection in China, administrative, civil and other social security measures alone are not enough to curb the destruction of grassland ecological environment by enterprises, and the restoration of grassland ecology has little effect. The intervention of criminal law is of great significance to the protection of grassland ecology. In view of the destruction of grassland ecological environment by enterprise behavior, the most reasonable way to intervene in criminal law is to improve the provisions of corporate criminal responsibility on the basis of promoting the concept of grassland ecological legal interest protection. And then effectively curb the crime of destroying grassland ecology by enterprises. Specifically, the perfection of Chinese enterprises' criminal responsibility in this respect should be reflected in the reset of the principle of imputation, the increase of the types of penalty and the promotion of the range of sentencing.
