【摘要】：正一、我国刑事立法和司法的更新与突破时代转型期对于成文刑法典而言无疑是"最坏的时代",法律滞后的固有缺陷被急剧放大。全新的网络危害行为的涌现和传统犯罪的网络异化,让刑事立法和司法不得不频繁做出"灭火式"的回应。
[Abstract]:First, the period of renewal and breakthrough of criminal legislation and judicature in our country is undoubtedly the "worst era" for the written criminal code, and the inherent defects of the legal lag have been magnified sharply. With the emergence of new network harm behavior and the alienation of traditional crime, criminal legislation and judicature have to respond frequently.
