伪基站电信诈骗的犯罪研究

【摘要】：在目前的犯罪活动中,犯罪形式呈现多样化趋势,利用伪基站电信诈骗就是其中新兴的一种。伪基站电信诈骗的犯罪形式主要是围绕伪基站为主要的犯罪工具或者是犯罪对象的一系列犯罪行为。伴随着我国经济形势的快速发展,传统的诈骗犯罪已经开始更新换代,进而出现了非接触式的诈骗犯罪,最为典型的便是伪基站电信诈骗。在最近几年的诈骗犯罪中,伪基站电信诈骗发展越来越迅速,很多的不法分子利用非法生产以及购买的伪基站对手机中的信息进行窃取,随意的冒充公众的手机号码,进行一些违法以及强制的营销、诈骗活动,严重危害了国家和人民的利益。通过对伪基站电信诈骗的研究可知,此项犯罪在其发展中有着自身的特点。首先,在目前我国伪基站电信诈骗的犯罪中,犯罪率越来越高,相关学者对伪基站电信诈骗犯罪的研究也在逐渐增多,但是,针对有效的预防和防控伪基站电信诈骗犯罪的方式和方法仍然并不多见。其次,由于目前科学技术的飞速发展,伪基站电信诈骗的手段也是越来越多。当前,我国开展了一系列打击伪基站电信诈骗犯罪行动,取得了一定的成效和经验;而且在全国公安系统中开通了不同区域、部门进行协作办案的一些公众平台和防范伪基站电信诈骗的平台,并已经在实践中有效的运用起来,这些平台在伪基站电信诈骗的实际预防和打击中取得了一定的效果,但是,伪基站电信诈骗形势严峻多变,在实际工作中仍然暴露出很多的问题和不足。然后,需要国家层面对伪基站电信诈骗犯罪的立法制度方面进行不断完善,同时各部门要切实落实监管工作,不同执法部门要不断完善技术以及监管措施,使得伪基站电信诈骗犯罪没有生存空间,有效遏制其发展和蔓延;最后,鉴于伪基站电信诈骗犯罪出现的时间比较短,发展比较迅速,有关学者对伪基站电信诈骗的研究还是相对停留在表面且数量不多,还需要在这方面进行大量的深入分析和研究。对于伪基站电信诈骗犯罪而言,在预防以及打击方面仍存在的一些薄弱环节,以犯罪学角度,提出一些能够具体可以实际操作的对策和建议,对伪基站电信诈骗犯罪的打击有着更强的指导和操作意义。从而可以逐步构建起伪基站电信诈骗犯罪的有效防控体系,更好的遏制伪基站电信诈骗犯罪的发展和蔓延。
[Abstract]:In the current criminal activities, the crime forms show a diversified trend, the use of pseudo-base station telecommunications fraud is one of the emerging. The crime form of pseudo-base station telecom fraud is mainly a series of criminal acts around pseudo-base station as the main criminal instrument or the object of crime. With the rapid development of China's economic situation, the traditional fraud crime has begun to update, and then there is a contactless fraud crime, the most typical of which is the pseudo-base station telecom fraud. In recent years, in the crime of fraud, the pseudo-base station telecom fraud has been developing more and more rapidly. Many lawbreakers use the illegal production and purchase of pseudo-base stations to steal the information in the mobile phone and impersonate the mobile phone number of the public at will. Some illegal and compulsory marketing, fraud, serious harm to the interests of the country and the people. Through the research of pseudo-base station telecom fraud, this crime has its own characteristics in its development. First of all, in the crime of fraud of pseudo base station telecom in our country, the crime rate is higher and higher, and the research on fraud crime of pseudo base station telecom is increasing gradually, however, There are few ways and means to prevent and control false base station telecom fraud. Secondly, due to the rapid development of science and technology, pseudo-base-station telecom fraud means are more and more. At present, our country has launched a series of operations to crack down on the crime of fraud of pseudo-base station telecommunications, and has achieved certain results and experience; moreover, it has opened up different regions in the national public security system. Some public platforms and platforms to guard against the fraud of pseudo-base station telecommunications, which departments work together to handle cases, have been effectively used in practice. These platforms have achieved certain results in the actual prevention and crackdown of the fraud of pseudo-base station telecommunications, but, The situation of pseudo-base station telecom fraud is severe and changeable, and it still exposes a lot of problems and deficiencies in actual work. Then, at the national level, we need to continuously improve the legislative system for the fraud crime of pseudo-base station telecommunications, and at the same time, all departments should effectively implement the supervision work, and different law enforcement departments should constantly improve the technology and regulatory measures. Make the pseudo-base station telecom fraud crime has no living space, effectively curb its development and spread; finally, in view of the relatively short time and rapid development of the pseudo-base station telecommunications fraud crime, The research on pseudo-base station telecom fraud is still relatively superficial and the number is small, and a large number of in-depth analysis and research are needed in this area. For the fraud crime of pseudo-base station telecommunications, there are still some weak links in the aspect of prevention and strike. From the perspective of criminology, some countermeasures and suggestions that can be concretely operated are put forward. It has stronger guidance and operation significance to attack the fraud crime of pseudo-base station telecom. Thus, the effective prevention and control system of false base station telecom fraud crime can be constructed step by step, and the development and spread of pseudo base station telecom fraud crime can be better restrained.
