论生产安全犯罪领域中渎职者的刑事责任

【摘要】：生产安全犯罪领域中的渎职行为不会直接造成安全事故的实害结果,与实害结果之间存在的是间接因果关系。然而,不正确履行安全生产监管的特定义务既是渎职犯罪的前提条件,也是危害生产安全行为发生的重要原因,渎职者应该对危害生产安全行为造成的危害后果承担完全的刑事责任。渎职犯罪量刑幅度高于危害生产安全犯罪量刑幅度,不违反罪责刑相适应的刑法基本原则,与渎职者的职业伦理相称,符合社会公众的朴素情感。
[Abstract]:Dereliction of duty in the field of production safety crime does not directly result in the actual harm of the safety accident, and there is an indirect causal relationship between the actual harm and the actual harm. However, the improper implementation of the specific obligations of production safety supervision is not only a prerequisite for dereliction of duty, but also an important reason for endangering production safety. Dereliction of duty should bear full criminal responsibility for the harmful consequences of acts against production safety. The penalty range of dereliction of duty is higher than that of the crime of endangering production safety, it does not violate the basic principle of criminal law, and is proportional to the professional ethics of dereliction of duty, and accords with the simple emotion of the public.
