【摘要】：近年来，伴随我国市场经济的迅猛发展与繁荣，一些不正当的经济竞争也接踵而来，商业贿赂行为在此环境下滋生蔓延。在中国，几乎所有商业领域的业务活动都被该“病毒”侵入，这个现象在一些行业和领域表现尤为明显，破坏了我国社会主义市场经济秩序，毒化政风、行风和社会风气，滋生腐败行为和经济犯罪，已成为经济社会生活中的一大公害。医药行业在我国乃至全球范围内有着无与伦比的重要性，人们对其有着绝对的依赖性。医药行业对每一个人来讲都是不可或缺的，这一特性也使该领域成为商业贿赂的重灾区。2006年爆发的天津德普案直击我国医药领域商业贿赂问题，也由此揭开了我国医药领域商业贿赂的神秘的面纱。2013年6月曝光的葛兰素史克商业贿赂案再次引发了我国医药领域的大地震。此次地震风波迅速席卷其他众多外资及本土药企，随后接连爆出其他药企、医疗机构涉嫌商业贿赂。从其中我们也不难看到，虽然经过多年治理，但是医药领域的商业贿赂问题仍然严重。随着反腐力度的加大，涉案数目、标的可能还会有上升趋势。本文即以医药领域商业贿赂为对象展开研究。文章共分四部分，第一部分是商业贿赂犯罪的简单概述。其中对正当的商业行为、商业贿赂违法及商业贿赂犯罪进行了区分辨析。第二部分是医药领域商业贿赂犯罪的现状概括。对我国目前医药行业的商业贿赂犯罪现状及危害进行描述。第三部分是文章核心，，阐述了我国目前对医药行业商业贿赂犯罪的司法认定。通过该章节的梳理方便我们认识我们整治医药行业商业贿赂犯罪的立法现状，以期望能够透过现象发现问题，追本溯源并寻出解决问题的对策。最后一部分是个人对整治医药行业商业贿赂犯罪的一点思考。医药行业商业贿赂犯罪是商业贿赂犯罪在一个行业领域的体现，它虽有其行业的特性，但也不脱离其商业贿赂犯罪的本质属性，所以在本章节中笔者站在商业贿赂犯罪整体角度对其在刑法的完善上提出了个人观点。
[Abstract]:In recent years, with the rapid development and prosperity of China's market economy, some unfair economic competition has been followed, and commercial bribery has spread in this environment. In China, almost all business activities in commercial fields have been invaded by the virus. This phenomenon is particularly evident in some industries and fields, undermining the socialist market economic order in our country and poisoning the political, business and social atmosphere. Breeding corruption and economic crime, has become a major public hazard in economic and social life. The pharmaceutical industry has unparalleled importance in our country and even the whole world, and people have absolute dependence on it. The pharmaceutical industry is indispensable to everyone, and this characteristic also makes the field a major disaster area for commercial bribery. The Tianjin Depp case broke out in 2006, directly attacking the issue of commercial bribery in the pharmaceutical field in China. The case of GlaxoSmithKline commercial bribery in June 2013 once again triggered a major earthquake in the field of medicine in China. The earthquake quickly swept across many other foreign and local drug companies, followed by a spate of other drug companies, medical institutions suspected of commercial bribery. It is not difficult to see that, despite years of governance, but the pharmaceutical sector of commercial bribery is still serious. With the increase of anti-corruption, involved in the number, the target may also have an upward trend. This paper focuses on commercial bribery in the field of medicine. The article is divided into four parts, the first part is a brief overview of the crime of commercial bribery. Among them, the legitimate commercial behavior, commercial bribery illegal and commercial bribery crime are distinguished. The second part is the summary of the current situation of the commercial bribery crime in the field of medicine. This paper describes the present situation and harm of the crime of commercial bribery in the pharmaceutical industry in China. The third part is the core of the article. Through the combing of this chapter, we can understand the current situation of our legislation to deal with the crime of commercial bribery in the pharmaceutical industry, in order to find the problem through the phenomenon, trace back to the source and find out the countermeasures to solve the problem. The last part is the personal thinking on the regulation of the pharmaceutical industry commercial bribery crime. The crime of commercial bribery in the pharmaceutical industry is the embodiment of the crime of commercial bribery in a profession. Although it has its own characteristics of the industry, it is not divorced from its essential attribute of the crime of commercial bribery. Therefore, in this chapter, the author puts forward personal views on the perfection of criminal law from the perspective of commercial bribery crime.
