论我国恐怖主义犯罪立法的不足与完善

【摘要】：当前,恐怖主义犯罪已成为世界和平与安全的最主要威胁,对一个国家的经济、信息、政治甚至主权安全都造成了相当程度的损害。中国和世界各国组成了国际反恐统一战线,均明确表达了反对恐怖主义犯罪的坚定立场。要重视反恐怖主义犯罪立法,尽快颁布《反恐怖主义法》以及对刑法进行修正,大力推动我国与国际世界的接轨和促进国际合作,从而更好维护我国稳定和安全。本文围绕恐怖主义犯罪的相关国际条约和域外立法,我国恐怖主义犯罪的趋势和现状,研究现有反恐法律体系,在内容结构上包括以下几个部分：第一部分主要研究惩治恐怖主义犯罪的基本概念以及发展渊源,对国际组织和各国对恐怖主义犯罪的定义进行考察研究,从而对恐怖主义犯罪的概念做出界定。第二部分主要是罗列了相应国际条约和先进国家对恐怖主义犯罪的立法,并进行分析,对立法模式以及概念内涵描述等问题提出自己的思考和借鉴。第三部分主要讲述我国恐怖活动犯罪发展的趋势及其危害性。一个是受国际环境的影响,如境外恐怖势力的借机煽动族群对立分裂,意图搅乱我国正常的和平发展局面；另一个是受地域环境的影响,如新疆东突势力的长期存在,对我国西部边疆地区乃至全国的安全稳定带来极大威胁；另外还有“台独”问题,这些均成为影响我国稳定与发展的重要不稳定因素。第四部分主要以我国关于恐怖主义犯罪的现有法律和现状进行分析,提出其存在的不足。第五部分则是在对比国外优秀反恐立法的基础上,从立法模式、罪名设置等几个方面对我国反恐怖主义犯罪立法提出实质性建议,如扩大关于对恐怖主义犯罪的管辖范围,全面灵活运用附加刑,全面灵活运用附加刑,以及对追诉时效进行特殊规定,并对分则罪名进行完善。
[Abstract]:At present, the crime of terrorism has become the main threat to world peace and security, which has caused considerable damage to a country's economy, information, politics and even sovereign security. China and the rest of the world have formed an international anti-terrorist United front and have clearly expressed their firm stand against terrorist crimes. We should attach great importance to the legislation on anti-terrorism crimes, promulgate the Anti-Terrorism Law as soon as possible and amend the criminal law so as to vigorously promote our country's integration with the international world and promote international cooperation, so as to better maintain our country's stability and security. This paper focuses on the relevant international treaties and extraterritorial legislation of terrorist crimes, the trend and current situation of terrorist crimes in China, and studies the existing anti-terrorism legal system. The content structure includes the following parts: the first part mainly studies the basic concepts and development sources of punishing terrorist crimes, and studies the definition of terrorist crimes in international organizations and countries. In order to define the concept of terrorist crime. The second part mainly lists the corresponding international treaties and the legislation of the advanced countries on the crime of terrorism, and carries on the analysis, puts forward own thinking and the reference to the legislative model and the concept connotation description and so on. The third part mainly narrates the development trend and harmfulness of the crime of terrorist activities in our country. One is influenced by the international environment, such as the overseas terrorist forces taking the opportunity to incite ethnic antagonism and division, with the intention of stirring up the normal situation of peaceful development in our country; the other is affected by the regional environment, such as the long-term existence of the forces of the East Turkistan in Xinjiang. It poses a great threat to the security and stability of the western frontier areas and even the whole country, and there are also the problems of "Taiwan independence", which have become an important unstable factor affecting the stability and development of our country. The fourth part mainly analyzes the existing laws and the present situation of the terrorism crime in our country, and points out its deficiency. The fifth part, on the basis of contrasting foreign excellent anti-terrorism legislation, puts forward substantive suggestions on the legislation of anti-terrorist crime in our country from several aspects, such as expanding the jurisdiction of terrorism crime, such as expanding the scope of jurisdiction on terrorism crime, from several aspects, such as legislative model, charge setting and so on. Fully flexible use of additional punishment, as well as the statute of limitations of special provisions, and the improvement of the specific charges.
