【摘要】：正刑罚是古代法律制度的重要构成内容,其发展与演变实质上也反映了中国社会的发展与进步。刑罚发展与变化的原因与表现都是多层次的,但是整体趋势是从原始的野蛮、落后、残暴向着文明、慎刑方向发展。《汉唐刑罚演变特点研究》一书运用了对比研究的方式,将汉代与唐代的刑罚作为研究对象,对汉代与唐代的死刑、流刑、劳役刑、身体刑等
[Abstract]:Positive penalty is an important component of ancient legal system, and its development and evolution reflect the development and progress of Chinese society. The causes and manifestations of penalty development and change are multi-level, but the overall trend is from primitive barbarism, backwardness, cruelty to civilization and careful punishment. Taking the penalty of Han Dynasty and Tang Dynasty as the object of study, the death penalty, flow penalty, servitude penalty, body punishment and so on in the Han Dynasty and the Tang Dynasty are studied.
