关于L省拒不支付劳动报酬犯罪的调研报告

【摘要】:随着市场经济的逐步发展,劳动力市场也愈来愈兴旺。但是,因劳动力市场的日益壮大,劳务纠纷、用工单位“恶意欠薪”的现象频频发生。为了打击“恶意欠薪”、严重扰乱劳动力市场秩序的行为,2011年《刑法修正案(八)》第四十一条增加规定了拒不支付劳动报酬罪,将“恶意欠薪”正式写入刑法。拒不支付劳动报酬罪的入刑,标志着我国对劳动者最大限度的保护,用法律的最后一道防线——刑法,保障着劳动者的合法权益。 立法者将拒不支付劳动报酬罪写入《刑法》,即侵犯财产罪一章中,作为刑法第276条(非法经营罪)之一,非法经营的犯罪对象是社会主义市场经济秩序,该罪同样严重扰乱了社会主义市场经济秩序,侵犯市场经济的正常运行,正是因为有极端的案件出现,使得其他无良的用工单位也纷纷效仿,造成市场的经济秩序混乱。将其纳入该章的目的是拒不支付劳动报酬犯罪已经与诈骗罪、侵占罪等侵犯他人财产性犯罪一样,严重侵害了他人的财产利益。 拒不支付劳动报酬罪的出台是国家不得不使用强制力约束欠薪的行为,该罪看似是刑法可有可无的罪名,,实际上,“恶意欠薪”行为会给劳动力市场甚至整个社会造成巨大的危害。每年劳动者因得不到薪酬而上访、自杀甚至引发暴力性事件的案例比比皆是。因此,对于“恶意欠薪”的行为,必须从司法实践中,发现其存在的问题并加以改正与完善。 本论文是一篇调研报告,调研数据来源于L省10个市法院审管办以及向各市部分法官发放调查问卷,最终通过汇总、归纳,得出结论,对数据进行分析。通过调研结论,笔者将本文分成三部分,以实证分析和理论分析的方式,阐述拒不支付劳动报酬犯罪。第一部分,笔者对L省拒不支付劳动报酬犯罪的调研情况进行全面的分析,总结出L省关于发生本罪的四个特点。第二部分,笔者针对对L省所犯拒不支付劳动报酬罪的调研情况,汇总L省产生拒不支付劳动报酬现象的原因。第三部分,笔者对拒不支付劳动报酬罪的立法存在的缺陷提出观点,并对该罪目前的现状提出立法建议。
[Abstract]:With the gradual development of market economy, labor market is more and more prosperous. However, due to the growing labor market and labor disputes, the phenomenon of malevolent wages owed by employers occurs frequently. In order to crack down on "maliciously unpaid wages" and seriously disturb the order of the labor market, Article 41 of the Criminal Law Amendment (VIII) in 2011 provides for the crime of refusing to pay the remuneration for work, and formally enshrines "maliciously unpaid wages" in the Criminal Law. The crime of refusing to pay the remuneration of labor marks the maximum protection of the laborer in our country, and the criminal law, the last line of defense of the law, ensures the legitimate rights and interests of the laborer. The lawmaker wrote the crime of refusing to pay the remuneration of labor into the Criminal Law, that is, the crime of infringing on property. As one of the 276th (the crime of illegal operation) of the Criminal Law, the object of the crime of illegal operation is the socialist market economic order. This crime has also seriously disturbed the socialist market economic order and infringed the normal operation of the market economy. It is precisely because of the emergence of extreme cases that other unscrupulous employment units have followed suit, resulting in confusion in the economic order of the market. The purpose of its inclusion in this chapter is that the crime of refusing to pay labor remuneration has infringed upon the property interests of others as well as the crime of fraud, embezzlement and other crimes of infringing upon the property of others. The crime of refusing to pay for labor is the act that the state has to use coercive force to restrain wages in arrears. This crime seems to be an optional crime in criminal law. In fact, Malevolent underpayment will do great harm to the labor market and even to the whole society. Every year workers go to the office without pay, suicides and even violent incidents abound. Therefore, to the behavior of "maliciously owed wages", we must find its problems in judicial practice and correct and perfect it. This paper is a research report, the research data from the L province of 10 municipal courts and the distribution of questionnaires to the judges of each city, finally through the summary, induction, conclusion, analysis of the data. Through the research conclusion, the author divides this article into three parts, and expounds the crime of refusing to pay the labor reward by the way of empirical analysis and theoretical analysis. In the first part, the author makes a comprehensive analysis of the crime of refusing to pay for labor in L province, and summarizes the four characteristics of the crime in L province. In the second part, according to the investigation of the crime of refusing to pay labor remuneration committed in L province, the author summarizes the reasons for the phenomenon of non-payment of labor remuneration in L province. In the third part, the author puts forward his views on the defects of the legislation of the crime of refusing to pay the remuneration for labor, and puts forward some legislative suggestions on the present situation of the crime.
