仇恨犯罪立法比较研究

【摘要】：仇恨犯罪的概念由来已久，无论是我国还是西方国家都有传统复仇文化导致的犯罪，就可以说是仇恨犯罪的雏形。美国以及部分欧洲国家早在数十年前就开始研究仇恨犯罪，所以无论是立法司法还是执法方面都有了一定的经验。然而，我国无论是刑法学界还是刑事实践活动都对仇恨犯罪关注很少，即使有少数学者研究国外的仇恨犯罪理论，也更没有从传统复仇文化的深度去分析仇恨犯罪的社会危害性并进入到立法可行性分析中去。由于我国将长期处于社会主义发展的初级阶段，，在现代化建设转型的背景下，社会不和谐因素增加与各类矛盾凸显，所以，和仇恨动机相关的犯罪也渐渐增加。在这个背景下，我国刑法学界学者并没有重视仇恨犯罪，对于仇恨犯罪的理论和实践都研究甚少。因此，通过比较研究国内外的仇恨犯罪理论和借鉴反思国外的立法模式，将有利于在立法和司法实践中正确处理因仇恨而引发的犯罪问题，充分打击和惩治仇恨犯罪，保护公民的人身权利，缓和社会矛盾，保障社会稳定和社会主义现代化建设事业顺利进展。
[Abstract]:The concept of hate crime has a long history, whether in our country or in western countries, the crime caused by traditional revenge culture can be said to be the embryonic form of hate crime. The United States and some European countries began to study hate crime decades ago, so they have some experience both in legislative, judicial and law enforcement. However, our country pays little attention to hate crime, not only in criminal law circles but also in criminal practice, even though there are a few scholars who study the theory of hate crime in foreign countries. It also does not analyze the social harmfulness of hate crime from the depth of traditional revenge culture and enter into the feasibility analysis of legislation. As our country will be in the primary stage of socialist development for a long time, under the background of modernization construction transformation, the increase of social disharmony factors and all kinds of contradictions highlight, therefore, the crime related to hate motive is also gradually increasing. In this context, the scholars of criminal law in our country do not attach importance to hate crime, and the theory and practice of hate crime are seldom studied. Therefore, by comparing the theory of hate crime at home and abroad and reflecting on the legislative model of foreign countries, it will be beneficial to correctly deal with the crime caused by hatred in legislation and judicial practice, and to crack down and punish hate crime adequately. To protect citizens' personal rights, ease social conflicts, and ensure social stability and smooth progress in socialist modernization.
