马克思反腐败思想下的职务犯罪防治体系构建

【摘要】：职务犯罪作为一个痛疾，一直困扰着各国政府和社会。随着法制建设的发展，职务犯罪问题越来越成为社会关注的焦点。作为社会主义国家的中国，正处在巨大的社会变迁和制度变革时期，职务犯罪问题更成为关系党和国家生死存亡的重大问题。正因如此，对职务犯罪及其防治的研究，成为学者们关注的对象。他们从不同学科，不同角度对其展开了深入的研究和探讨。职务犯罪是一种复杂的社会现象，并与社会运行和发展的因素密切联系。党的十八大以来，我国严厉打击职务犯罪，查处了大量的腐败问题。反腐败收到成效的同时，在很多领域职务犯罪依然存在，亟需建立职务犯罪防治的系统体系，更加有效的巩固反腐成果，也为以后的反腐败工作提供指导。 马克思关于反腐败的思想是我国反腐败思想的源头。他的反腐倡廉的思想对我国的反腐败思想的发展和反腐败机制的建立具有深远的影响。我国的几代国家领导人在充分借鉴和发展马克思反腐败思想的基础上，在长期的反腐败斗争中总结形成了丰富的思想理论和实践经验，逐步形成了具有中国特色的反腐倡廉思想，有力的指导了我国的反腐败工作。毛泽东在其著作中反复强调对贪污腐败的严厉打击。邓小平的反腐思想则始终贯彻着实事求是的思想。以江泽民为代表的党的第三代领导人充分认识到了反腐败的紧迫性长期行和艰巨性。胡锦涛同志提出要模范的践行社会主义荣辱观自觉抵制不良思想的侵袭。 本文首先对马克思主义反腐倡廉思想及其中国化的发展进行论述，在此基础上对毛泽东关于反腐倡廉的思想进行分析，阐明邓小平关于反腐倡廉的论述。同时对新时期的反腐思想进行分析，试图通过对反腐败思想理论的系统研究，为我国预防和打击职务犯罪提供理论指导。同时在对职务犯罪问题的现状进行分析探究的基础上，分析职务犯罪产生的多层次原因。在剖析职务犯罪产生原因的基础上，试图从反腐倡廉的思想政治教育方面、人生观和价值观教育和具体措施落实方面，阐述预防和打击职务犯罪的措施，并在职务犯罪防治手段和防治过程中构建职务犯罪防治控制体系，，为从根源上预防和减少腐败犯罪提供指导。
[Abstract]:As a painful disease, job-related crime has been puzzling governments and society all over the world. With the development of legal system, the problem of duty crime has become the focus of attention. As a socialist country, China is in a period of great social changes and institutional changes, and the issue of job-related crimes has become a major issue related to the life and death of the Party and the country. Therefore, the research on duty crime and its prevention has become the object that scholars pay attention to. They carried out deep research and discussion on it from different subjects and different angles. Job-related crime is a complicated social phenomenon and is closely related to the factors of social operation and development. Since the 18th National Congress of the Party, China has severely cracked down on job-related crimes and dealt with a large number of corruption problems. At the same time, there are still many fields of job-related crimes, so it is urgent to establish a system of prevention and control of job-related crimes, to consolidate the achievements of anti-corruption more effectively, and to provide guidance for the future anti-corruption work. Marx's thought on anti-corruption is the source of anti-corruption thought in our country. His anti-corruption thought has profound influence on the development of anti-corruption thought and the establishment of anti-corruption mechanism in our country. On the basis of fully drawing lessons from and developing Marx's anti-corruption thought, the leaders of several generations of countries in our country have summed up and formed rich ideological theory and practical experience in the long struggle against corruption. It has gradually formed the anti-corruption thought with Chinese characteristics and guided the anti-corruption work of our country. In his writings, Mao Zedong has repeatedly stressed the harsh crackdown on corruption. Deng Xiaoping's anti-corruption thought is always carrying out the thought of seeking truth from facts. The third generation leaders of the Party, represented by Jiang Zemin, fully realized the urgency and arduous nature of anti-corruption. Comrade Hu Jintao proposed to practice the socialist concept of honor and disgrace consciously resist the invasion of bad ideas. In this paper, the author first discusses the Marxist anti-corruption and the development of anti-corruption in China, on the basis of which Mao Zedong's thought on anti-corruption and clean government is analyzed, and Deng Xiaoping's exposition on anti-corruption and clean government is expounded. At the same time, the author analyzes the anti-corruption thought in the new period, and attempts to provide theoretical guidance for our country to prevent and crack down on job-related crime through the systematic research on the theory of anti-corruption thought. At the same time, on the basis of analyzing and exploring the present situation of duty crime, the multi-level causes of duty crime are analyzed. On the basis of analyzing the causes of job-related crimes, this paper attempts to expound the measures to prevent and combat job-related crimes from the aspects of ideological and political education against corruption, education of outlook on life and values, and implementation of concrete measures. And the prevention and control system of duty crime is constructed in the process of prevention and control of duty crime, which provides guidance for the prevention and reduction of corruption crime from the root.
