我国网络谣言刑法规制问题研究

【摘要】：网络谣言是指:没有相应事实根据而被故意捏造出来,通过网络媒介进行散布和传播并为相应公众所知晓的言论。网络谣言随处可见,其危害也显而易见,并随着网络的普及而逐渐扩大。网络谣言不仅对自然人、法人等私权主体危害巨大,对正常的社会、经济秩序也造成了不小的影响,甚至还会影响到民族的团结与国家的稳定。然而,刑法在规制网络谣言的过程中存在诸多缺陷,致使其不足以遏制网络谣言蔓延之趋势。因此在明确网络谣言内涵之基础上,提出合法合理之建议以求得根治网络谣言之成效。本文约两万多字,分为五个部分:第一部分为网络谣言的概述。在这个部分中厘清了网络谣言的基本概念,界定了网络谣言的几点基本特征,分析了网络谣言形成的原因及主要危害。从而对网络谣言有了一个基本的了解,并明确了刑法规制网络谣言的重要意义。第二部分为刑法规制网络谣言的现状与分类。阐述了网络谣言与刑法之间的关系,明确了网络谣言的相关行为并不当然构成刑事犯罪并且网络谣言仅仅是承载各类犯罪的一种方式。进而了解到我国刑法规制网络谣言类型犯罪的现状。根据我国的刑法体系对网络谣言类型的犯罪进行了合理的分类。第三部分至第五部分是本文的核心内容。根据现行刑事法律,分析其在规制网络谣言犯罪过程中所存在的种种问题,并对相关问题进行归纳与分析。列举了国外相关国家在刑法规制网络谣言过程中的宝贵经验。通过对问题的分析与探讨,以及对经验的借鉴与吸收,提出相应的对策与措施以解决刑法规制网络谣言过程中的问题。总之,只有明确刑法规制网络谣言界限的基础之上才能更好地起到相应的效果,以防止和杜绝网络谣言产生。
[Abstract]:Internet rumor refers to the speech which is deliberately fabricated without corresponding facts and disseminated through the network media and known to the corresponding public. Internet rumors can be seen everywhere, its harm is obvious, and with the popularity of the network and gradually expand. Internet rumors not only do great harm to the private right subjects such as natural persons and legal persons, but also have a great impact on the normal social and economic order, and even affect the unity of the nation and the stability of the country. However, the criminal law has many defects in the process of regulating network rumors, which makes it insufficient to curb the spreading trend of network rumors. Therefore, on the basis of defining the connotation of network rumor, the author puts forward legal and reasonable suggestions to achieve the effect of radical cure of network rumor. This paper, about 20,000 words, is divided into five parts: the first part is an overview of Internet rumors. In this part, the author clarifies the basic concept of the network rumor, defines several basic characteristics of the network rumor, and analyzes the reason and the main harm of the formation of the network rumor. So we have a basic understanding of the network rumors and the significance of the criminal law to regulate the network rumors. The second part is the current situation and classification of criminal law regulating network rumors. This paper expounds the relationship between network rumor and criminal law, and clarifies that the related behavior of network rumor does not constitute a criminal crime of course and that network rumor is only a way to carry all kinds of crimes. Then we know the current situation of the criminal law of our country to regulate the crime of network rumor type. According to the criminal law system of our country, the crime of network rumor type is classified reasonably. The third part to the fifth part is the core content of this paper. According to the current criminal law, this paper analyzes the problems existing in the process of regulating the crime of network rumor, and sums up and analyzes the related problems. This paper enumerates the valuable experience of foreign countries in the criminal law regulation of online rumors. Through the analysis and discussion of the problems, as well as the reference and absorption of the experience, the corresponding countermeasures and measures are put forward to solve the problems in the course of regulating the network rumors in the criminal law. In a word, only on the basis of defining the limits of criminal law to regulate the network rumor can it play a better effect in order to prevent and put an end to the emergence of the network rumor.
