扰乱法庭秩序罪的行为研究

【摘要】：纵观世界法律发展史,对于扰乱法庭秩序和损害司法权威的行为,无论是英美法系还是大陆法系,都予以了法律制裁。《刑法修正案(九)》对扰乱法庭秩序罪进行了重大修改,扩容了扰乱法庭秩序罪的行为,很好的回应了司法需求,但同时也引发了极大的争议。有学者认为修改后增加的侮辱、诽谤、威胁诉讼参与人的行为与侮辱、诽谤罪、寻衅滋事罪在行为方式上存在竞合关系,可以通过侮辱罪、诽谤罪和寻衅滋事罪来规制不合理的扰乱法庭秩序行为,无须增加扰乱法庭秩序罪的入罪行为。律师界则有观点认为增加犯罪行为容易导致该罪被滥用,从而会限制律师辩护权,甚至不敢辩护。笔者认为引发争议的主要原因是扰乱法庭秩序罪客观行为的界定不清晰,因此,笔者从扰乱法庭秩序罪的修改背景出发,结合犯罪行为的罪状描述,对扰乱法庭秩序罪的行为进行研究。首先是引言部分,主要阐述扰乱法庭秩序罪的修改背景、修改内容及各方观点。其次对扰乱法庭秩序行为的限制性条件进行分析,对行为的时间条件和场所条件作详细说明。最后是对扰乱法庭秩序罪的行为进行逐一解析,通过比照刑法总则的规定和分则中相似的犯罪,结合扰乱法庭秩序罪罪状描述,尝试界定各个行为的含义,对行为的争议进行分析并阐明自己的观点,希望可以为司法实务中扰乱法庭秩序罪的适用提供参考。
[Abstract]:Throughout the history of world law, whether it is common law system or civil law system, the behavior that disturbs the court order and damages the judicial authority is not only a common law system, but also a civil law system. The amendment of the Criminal Law (9) made a major amendment to the crime of disturbing the order of the court, expanded the behavior of the crime of disturbing the order of the court, and responded well to the demand of the judiciary, but at the same time caused great controversy. Some scholars believe that there is a competing relationship between the behavior of the insult, libel, threat to the litigant participants and insults, libel, and the crime of provoking trouble after the amendment, which can be carried out through the crime of insult. The crime of libel and provocation is used to regulate the unreasonable behavior of disturbing the order of the court without the need to increase the incrimination of the crime of disturbing the order of the court. Lawyers argue that an increase in crime can lead to abuse of the crime, which limits lawyers' right to defence and even does not dare to defend. The author believes that the main reason for the controversy is that the definition of the objective behavior of the crime of disturbing the order of the court is not clear. Therefore, the author starts from the background of the modification of the crime of disturbing the order of the court, and combines the description of the crime with the crime of disturbing the order of the court. Conduct a study of a crime against the order of a court. The first part is the introduction, which mainly expounds the background, the content and the viewpoints of the crime of disturbing the order of the court. Secondly, the restrictive conditions of disturbing the court order are analyzed, and the time and place conditions of the behavior are explained in detail. Finally, it analyzes the crime of disturbing the order of the court one by one, and tries to define the meaning of each act by referring to the similar crimes in the general provisions and sub-provisions of the criminal law, and combining the description of the charges of the crime of disturbing the order of the court. This paper analyzes the controversy of behavior and clarifies its own viewpoint, hoping to provide reference for the application of the crime of disturbing the court order in judicial practice.
