擅开应急舱门行为定性与相关刑法完善研究

【摘要】:旅客在我国航空器上擅自打开应急舱门的行为如何定性存在争议。我国《刑法》与《治安管理处罚法》中均有对该行为的制裁规范。一般而言,擅开飞机应急舱门行为对航空安全的危害达到现实和紧迫程度的适用刑罚,尚未达到这一程度则适用治安处罚。但是,对航空安全"现实和紧迫的威胁"的判断既是事实判断也是规范判断,不同主体有不同的认识,而且,不同的认识可能导致或处以最低3年有期徒刑,或仅处以最高15天行政拘留这样相差悬殊的后果。通过修订刑法,在破坏交通工具罪中增加"或者以任何其他方式损害或者妨害飞行中的航空器的功效或运行"的轻罪罪状,并为其设置"三年以下有期徒刑、拘役或者管制,并处罚金"的轻罪刑罚,使刑法规范与治安处罚规范相衔接,可以严密此类行为的制裁规范。
[Abstract]:It is controversial how passengers open emergency doors on Chinese aircraft without authorization. Both the Criminal Law and the Law on punishment of Public Security Administration have sanctions for this act. Generally speaking, the danger to aviation safety caused by unauthorized opening of emergency doors is the applicable penalty of realistic and urgent degree, but it is applicable to the public security penalty if it has not reached this level. However, the judgment of "realistic and urgent threat" to aviation safety is both factual and normative. Different subjects have different understandings, and different understandings may lead to or impose a minimum imprisonment of three years. Or only impose a maximum of 15 days of administrative detention as a result of the disparity. By amending the Criminal Law, to add to the crime of sabotage of means of transport a misdemeanor of "or in any other way impair or impair the efficacy or operation of an aircraft in flight", and to provide it with "fixed-term imprisonment of not more than three years, criminal detention or public surveillance," The punishment of misdemeanor, which makes the criminal law standard and the public order punishment standard, can be strictly punished.
