前科就业限制的比例原则规制

【摘要】:现代社会是一个风险社会,每个人都可能面临被犯罪裹挟的风险。有效惩罚和预防犯罪是国家不可推卸的责任。前科就业限制通过立法的方式设定制度性排斥,将有前科的公民挑拣出来在就业中予以区别对待、限制或剥夺,以期实现预防犯罪,保护公共利益的目的。对有前科公民就业权的立法限制形成的制度性壁垒在很大程度上梗阻了有前科公民的权利保障与权利实现。这种限制应当具有正当性和必要性,遵循比例原则,接受目的正当性、手段适当性、必要性以及目的手段之间的均衡性检验。在限制程度、限制范围和限制方式上结合犯罪行为及犯罪人进行个案化、类别化判断,对前科就业限制进行规制,厘清国家权力在前科就业限制上的权力边界。
[Abstract]:Modern society is a risk society, everyone may face the risk of crime. Effective punishment and crime prevention is an unshirkable responsibility of the State. In order to prevent crime and protect public interest, the employment restriction of criminal record is set up by means of legislation, and the citizens with previous record are selected to be treated differently, restricted or deprived in employment, in order to achieve the purpose of preventing crime and protecting the public interest. To a great extent, the institutional barriers formed by the legislative restrictions on the employment rights of the citizens with criminal record obstruct the protection and realization of the rights of the citizens with criminal record to a great extent. This restriction should have legitimacy and necessity, follow the principle of proportionality, accept the legitimacy of the purpose, the appropriateness of the means, the necessity and the balance between the ends and means. In terms of the degree of restriction, the scope of restriction and the way of restriction, the author makes a case-by-case and classification judgment with criminal acts and criminals, regulates the restrictions on ex-criminal employment, and clarifies the power boundary of the state power on the restrictions on ex-criminal employment.
