食品监管渎职犯罪研究

【摘要】：食品监管渎职罪是《刑法修正案（八）》新增设的罪名，其目的在于维护国家食品监管正常秩序，，保护公众生命健康和财产安全。作为一项新的罪名，该罪在犯罪构成、法律适用上还存在着诸多的问题和争论。本文对此从理论及实践两方面展开分析与探讨，提出笔者的观点和建议。 本文共分四个部分：第一部分从食品监管渎职罪的立法背景和罪名确定入手，概述了本罪设置的必要性，分析了罪名确定的妥当性。第二部分从本罪的主体、危害行为、危害结果及罪过形式等方面入手，细致分析了本罪的主客观要件，为本文的研究奠定了基础。第三部分则从司法实务出发，对具体法律适用中存在的一些疑难问题进行了解析，提出了相对明确、合理的观点。最后，针对在立法和司法实践中存在的不足，提出了几点立法完善的建议，以期对该罪的立法和司法实践均有所裨益。
[Abstract]:The crime of malfeasance in food supervision is a new crime in Criminal Law Amendment (8). Its purpose is to maintain the normal order of national food supervision and protect public life and health and property safety. As a new crime, there are still many problems and controversies in the constitution and application of law. This paper analyzes and probes into this from both theoretical and practical aspects, and puts forward the author's views and suggestions. This paper is divided into four parts: the first part starts with the legislative background and the definition of the crime of food supervision dereliction of duty, summarizes the necessity of setting up the crime, and analyzes the appropriateness of the crime determination. The second part analyzes the subjective and objective elements of the crime from the aspects of the subject of the crime, the act of harm, the result of the harm and the form of the crime, which lays a foundation for the research of this paper. The third part, starting from the judicial practice, analyzes some difficult problems existing in the application of specific laws, and puts forward a relatively clear and reasonable point of view. Finally, in view of the shortcomings in the legislation and judicial practice, this paper puts forward some suggestions for the perfection of the legislation in order to benefit both the legislation and the judicial practice of the crime.
