【摘要】:随着城市的扩张与工业化的进程,在经济快速发展、土地价值提升的今天,我国的建设用地需求居高不下,现有的国有建设用地完全不能满足城市建设和发展的需要。农村集体经营性建设用地入市流转问题一直以来备受人们的关注,政府长期垄断着土地一级市场,农村土地要进入市场进行流转必须先经过国家的征收制度,将农村的集体土地征收转变为国有土地后才能进入土地市场进行交易,长久以来,政府“低价”征收土地“高价”出让土地以牺牲集体及农民利益的赚取差价的做法倍受社会指责,因此改变政府垄断土地一级市场的呼声日渐高涨。但我国现行法律法规限制甚至否定集体经营性建设用地进入土地市场进行公开流转,在这种法律依据欠缺的背景下,部分集体及农民在巨大的利益诱惑之下将农村集体经营性建设用地使用权进行转让,造成农村土地非法隐形入市流转,土地市场的混乱。基于此,部分城市大胆地开展了集体经营性建设用地入市流转的改革探索,取得了重要进展和丰富的经验,这些改革试点的城市也相继出台了集体经营性建设用地入市流转的规定,为集体经营性建设用地入市流转提供政策导向,国家也在总结试点经验的基础上推进改革,同时不断探索农村集体经营性建设用地使用权流转制度。集体经营性建设用地入市流转已势在必行,其良好的运行关系着农村的繁荣稳定、农民利益的保护、农业的发展前景和统筹城乡发展一体化的目标的实现。党的十七届三中全会通过的《中共中央关于推进农村改革发展若干重大问题的决定》(以下简称《决定1》)与党的十八届三中全会通过的《中共中央关于全面深化改革若干重大问题的决定》(以下简称《决定2》)对集体经营性建设用地的入市流转进行了宏观的统领性的制度设计,但这项流转制度的建立和运作是一项长期而系统的工程,其中仍然有很多问题亟待解决,仅仅依靠中央的政策来推进农村集体经营性建设用地流转也仍然存在很多障碍。因此,在未来的土地市场交易中要构建城乡统一的建设用地市场,推进集体经营性建设用地规范有序地入市流转,还需要进一步细化中央的顶层设计,明确具体操作办法、流程,完善相关法律法规及配套制度,以实现农村土地制度的顺利改革。
[Abstract]:With the expansion of cities and the process of industrialization, with the rapid development of economy and the promotion of land value, the demand for construction land in China remains high. The existing state-owned construction land can not meet the needs of urban construction and development. The circulation of rural collective management construction land has been the focus of attention for a long time, the government monopolizes the land market for a long time. Rural land to enter the market for circulation must first go through the national expropriation system, rural collective land expropriation into state-owned land before entering the land market transactions, for a long time. The government's practice of expropriating land at a low price and selling land at a high price at the expense of the collective and peasant interests has been criticized by society. Therefore, the voice of changing the government monopoly land market is rising day by day. However, the current laws and regulations of our country restrict or even deny the collective management of construction land into the land market for public circulation. In this lack of legal basis, some collectives and farmers in the huge interests of the temptation to use the rural collective management of construction land transfer, resulting in the illegal circulation of rural land into the market. Land market chaos. Based on this, some cities boldly carried out the collective management of construction land into the market circulation reform exploration, has made important progress and rich experience.
