【摘要】：随着我国经济的迅速发展,城市街巷面貌日新月异。城市道路作为市政建设的基础部分,其命名的规范化与城市建设、百姓生活息息相关。研究当下的城市道路是否规范合法,存在哪些法律问题以及如何完善具有研究的理论价值与现实意义。我国有关道路命名的现行法律法规是1986年颁布的《地名管理条例》、1996年颁布的《地名管理条例实施细则》和各省市制定的《xx地名管理办法》,法律法规已滞后于市政建设,在命名主体、命名程序以及救济方式等方面都存在诸多问题。本文的研究目的是探寻道路命名的规范化与法制化,笔者结合当下的社会现状,运用了实地调研、文献收集、比较研究等方法从法律法规、命名主体、命名程序、监管机制、救济方式等方面做了详细的论述与分析,并借鉴国外命名的理论与实践经验,为我国的道路命名提出了完善措施。文章分为六个部分,第一部分为绪论,主要介绍选题背景与研究意义、国内外的研究现状、本文的特色及创新之处。第二部分为概念的界定,文章论述的主体是城市道路,笔者对城市概念、道路的概念做了界定,并同公路和街道做了对比区分。第三部分总结了城市道路命名的五个原则。第四部分探讨当下城市道路命名存在的问题。第五部分为城市道路命名合法性分析,评论了我国道路命名的法律依据,从行政法的角度论述了命名规范化所存在的缺失。同时简单探讨了国外道路命名概况及对我国的实践与经验借鉴。第六部分着重从立法、执法、监管、救济等方面提出了完善措施。
[Abstract]:With the rapid development of economy in our country, the appearance of urban streets is changing with each passing day. As the basic part of municipal construction, urban roads are standardized and urban construction. People's lives are closely related. To study whether the current urban road is legal or not. What legal problems exist and how to improve the theoretical value and practical significance of the study. The current laws and regulations on road naming in China are the "regulations on the Administration of Geographical names" promulgated in 1986. In 1996, the rules for the implementation of the regulations on the Administration of Geographical names and the measures for the Administration of xx Geographical names formulated by various provinces and cities, the laws and regulations have lagged behind the municipal construction, in naming subject. There are many problems in naming procedures and relief methods. The purpose of this paper is to explore the standardization and legalization of road naming. Combined with the current social situation, the author makes use of field research and literature collection. Comparative study and other methods from the laws and regulations, naming subjects, naming procedures, regulatory mechanisms, relief methods and other aspects of the detailed discussion and analysis, and learn from foreign naming theory and practical experience. The article is divided into six parts, the first part is the introduction, mainly introduces the background and significance of the topic, domestic and foreign research status. The second part is the definition of the concept. The main body of the article is the urban road. The author defines the concept of the city and the concept of the road. The third part summarizes the five principles of urban road naming. Part 4th discusses the existing problems of urban road naming. Part 5th analyzes the legitimacy of urban road naming. This paper reviews the legal basis of road naming in China. This paper discusses the deficiency of naming standardization from the angle of administrative law. At the same time, it discusses the general situation of road naming in foreign countries and the practice and experience of our country. Part 6th focuses on legislation, law enforcement and supervision. Remedies and other aspects of the proposed improvement measures.
