交通事故中机动车贬值损失的赔偿问题研究

【摘要】：机动车贬值损失的赔偿关系到权利人合法权益的维护,同时对于统一司法实践中此类案件的裁判具有重要意义。当前理论界对于车辆贬值损失的赔偿有支持赔偿、反对赔偿、折中意见三种观点。支持赔偿观点主要认为车辆贬值损失是直接损失,按照侵权法全面赔偿原则理应得到赔偿;反对赔偿观点主要认为车辆贬值损失数额的确定缺少统一的认定标准和认定机构以及缺少为责任人分担风险的机构;折中观点主要认为车辆贬值损失究竟是否应当赔偿应当视车辆所有人是否具有出售车辆的意图而定。司法实践中对于此类案件的判决也各不相同。面对车辆贬值损失究竟是否应当赔偿以及贬值数额的确定方面,文章支持车辆贬值损失的赔偿,认为车辆贬值损失是客观存在的损失,是直接损失和实际利益损失,理应得到赔偿。同时,提出利用年限估算法来确定车辆贬值损失的数额,年限估算法相比其他方法更加客观合理、简便易行。另外,借鉴美国的车辆保值险,由保险公司适当分担遭遇道路交通事故的机动车的贬值损失,促进责任人义务的履行,构建完善的车辆贬值损失赔偿制度。
[Abstract]:The compensation for vehicle depreciation is related to the protection of the legitimate rights and interests of the obligee. At the same time for the unified judicial practice of the adjudication of such cases is of great significance. The current theoretical circle for vehicle depreciation losses of compensation for the support of compensation, against compensation. In support of compensation, it is believed that the loss of depreciation of vehicles is a direct loss and should be compensated in accordance with the principle of comprehensive compensation in tort law. The viewpoint of opposing compensation mainly holds that the determination of the amount of devaluing loss of vehicles lacks the uniform identification standard and the identifying organization and the organization that shares the risk for the person responsible; The compromise point of view is that whether the vehicle depreciation loss should be compensated depends on whether the owner of the vehicle has the intention to sell the vehicle. The judgment of this kind of case is also different in judicial practice. Whether the loss should be compensated or not, as well as the determination of the amount of depreciation. This paper supports the compensation of vehicle depreciation loss, and holds that the vehicle depreciation loss is an objective loss, a direct loss and a loss of actual interests, and should be compensated at the same time. This paper proposes to use the method of estimating the number of years to determine the amount of vehicle depreciation loss. The method is more objective and reasonable than other methods. In addition, it is easy to use for reference the American vehicle risk. The insurance company should share the depreciation loss of the motor vehicle in the road traffic accident, promote the duty of the responsible person, and construct the perfect compensation system of the devaluing loss of the vehicle.
