辅警参与执法规范化问题研究

【摘要】：辅警作为协助警察履行任务的重要力量，其存在的目的是缓解正规警力不足、维护社会治安。近年来，辅警在我国诸多地区得以广泛适用，在产生显著社会效果的同时，也出现了颇多的问题，譬如辅警参与执法时产生的问题、辅警队伍的管理问题等等。这些问题的出现，若找不到解决的方法，必然会影响辅警作用的发挥，与建立辅警的初衷相悖，甚至有些地区辅警立了废，，废了立，却仍不从根源上加以重视，忽视辅警存在的种种问题，怠于寻找解决问题的途径，从而导致了恶性循环，显然阻碍了辅警制度的发展与完善。本文主要是从辅警制度存在的问题为基础，重点探讨辅警参与执法规范化问题，全文分为四个部分，结构为总分结构，具体来看：第一部分是总论，从辅警的基础理论出发，分析辅警建立的背景、意义以及其适用中存在的问题，并从这些问题中找到本文的写作核心，即辅警参与执法的不规范问题；第二、三、四部分是分论，分别是对辅警参与执法不规范问题的具体研究，其中第二部分是从辅警参与执法的法律地位与权限出发，分析辅警参与执法时的法律地位与权限的内涵与问题，明确法律地位与权限的必要性，以及如何明确其法律地位与权限；第三部分论述的是辅警参与执法程序规范化问题，在分析程序规范的意义以及辅警参与执法存在的程序问题的基础上，得出一些关于辅警参与执法程序规范的思考；第四部分的主要内容是辅警参与执法的责任与监督，首先概述辅警参与执法责任与监督的内涵与关联，再从辅警参与执法责任与监督的现状与问题出发，寻求解决之路。以上内容就是本文的基本结构与主要观点，下文将会重点探讨。目前学术界关于辅警研究的文章较多，但多是从警察学与管理学的角度出发，无法解决辅警法治化的问题。因此，本文重点从法学与行政法的理论为基础，探讨有关辅警参与执法中的法治化、规范化问题。
[Abstract]:As an important force to assist the police to perform their tasks, the existence of Auxiliary Police Force aims to alleviate the shortage of regular police force and maintain public order. In recent years, Auxiliary Police Force has been widely used in many areas of our country. At the same time, there are a lot of problems, such as the problems that the auxiliary police take part in the law enforcement, the management of the auxiliary police force and so on. Will inevitably affect the role of Auxiliary Police play, and the establishment of Auxiliary Police is contrary to the original intention, even in some areas the Auxiliary Police have been abolished, scrapped, but still do not attach importance to the root causes, ignoring the problems of the Auxiliary Police. To find a way to solve the problem leads to a vicious circle, which obviously hinders the development and perfection of Auxiliary Police system. Based on the problems existing in the Auxiliary Police system, this paper focuses on the standardization of the participation of Auxiliary Police in the enforcement of the law. The full text is divided into four parts, the structure of which is the total sub-structure. The first part is a general theory, from the basic theory of Auxiliary Police, this paper analyzes the background, significance and problems in the application of Auxiliary Police Force, and finds the core of this paper from these problems. That is, the non-standard problem of auxiliary police participating in law enforcement; The second, third and fourth parts are divided into two parts, respectively, which are the specific research on the non-standard participation of auxiliary police in law enforcement. The second part is based on the legal status and authority of the auxiliary police participating in the law enforcement. This paper analyzes the connotation and problems of the legal status and authority of the auxiliary police when they participate in the law enforcement, the necessity of the legal status and authority, and how to define the legal status and authority of the auxiliary police. The third part discusses the problem of the participation of auxiliary police in law enforcement process standardization, on the basis of analyzing the significance of procedural norms and the existence of procedural problems of auxiliary police participation in law enforcement. Draw some thoughts on the participation of auxiliary police in law enforcement procedures; The main content of the 4th part is the responsibility and supervision of the auxiliary police participating in the law enforcement. Firstly, it summarizes the connotation and the relationship between the participation of the auxiliary police in the law enforcement responsibility and supervision, and then starts from the present situation and problems of the auxiliary police participating in the law enforcement responsibility and supervision. The above content is the basic structure and main viewpoints of this paper, which will be discussed below. At present, there are many articles about Auxiliary Police in academic circles, but most of them are from the angle of police science and management, which can not solve the problem of Auxiliary Police ruling by law. Therefore, this paper focuses on the theory of law and administrative law as the basis. This paper discusses the rule of law and standardization of the participation of auxiliary police in law enforcement.
