新型城镇化背景下的城管公正文明执法研究

【摘要】：城市管理行政执法问题是近年来社会普遍关注的热点问题,而在城市管理行政执法中不断出现的暴力执法、暴力抗法事件,更是逐渐成为街头巷尾热议的话题,也使人们对“城管”一词产生了偏见。究其原因,从根本上讲,是我国城管执法体制的弊端造成的。而随着新型城镇化概念的提出,我国城市管理难度加大,同时城市管理行政执法被寄予了更大的希望,旧有的行政执法模式已经不利于甚至会阻碍新型城镇化的建设。因此,全面深化城市管理行政执法体制,促进公正文明执法就显得很有必要。本文的写作即是在这一背景下进行的。文章的研究重点是分析和探讨目前我国城管执法体制存在的问题及完善的对策,通过对行政法基本理论的研究和文献调查法(对有关城管执法与体制方面的文献资料进行收集、研究和总结),试图从不同角度对改善我国城市管理目前的执法现状提出整改措施。第一部分：对我国城市执法体制的发展历程做了简单的梳理,从城建监察,到相对集中行政处罚权和城市综合行政执法,以及十八届三中全会提出的相对集中执法权。虽然城建监察属于城市建设行政执法部门,但了解城建监察制度的产生和发展,有助于我们更好的了解城管执法体制的演变。第二部分：对新型城镇化、城管执法和公正文明执法的基本含义以及公正文明执法对推进新型城镇化的意义做了简要阐述,为下文的进一步研究提供了时代背景与理论基础。第三部分：论述了新型城镇化进程中影响城市管理公正文明执法的原因,从三个大方向进行了分析,分别是城管执法制度本身的欠缺、城管执法行为不规范、城市管理行政执法队伍建设落后,每个方向细化为几个不同方面进行了详细阐述。第四部分：在充分研读了十八届三中全会关于全面深化城管体制改革的决定之后,以此为基础,从加强顶层设计、完善执法程序、强化法律监督三个方面对完善城管行政执法体制、加强公正文明执法提出了自己的见解,顶层设计又分别从制定专门的城市管理法、减少行政执法层级,加强基层执法力量、整合执法主体,相对集中执法权、理顺城管执法体制,提高执法和服务水平四个方面进行了重点论述,其中如何推进相对集中执法权是本文的难点也是创新点。
[Abstract]:In recent years, the issue of urban management administrative law enforcement is a hot issue that the society pays close attention to. However, the violent law enforcement and violence against the law, which appear constantly in the city management administration law enforcement, have gradually become a hot topic in the streets and alleys. It also makes people have a prejudice to the word "urban management". The reason is fundamentally caused by the malpractice of the law enforcement system of urban management in China. However, with the new concept of urbanization, the difficulty of urban management in our country has increased. At the same time, urban management administrative law enforcement has been placed in greater hope, the old administrative law enforcement model has been detrimental to or even hinder the construction of a new type of urbanization. Therefore, the comprehensive deepening of the urban management administrative law enforcement system. It is necessary to promote fair and civilized law enforcement. The research focus of this paper is to analyze and discuss the existing problems and perfect countermeasures of the law enforcement system of urban management in our country. Through the basic theory of administrative law research and literature survey (on the law enforcement and institutional aspects of urban management literature collection, research and summary). This paper attempts to put forward some rectification measures to improve the present law enforcement situation of urban management in China from different angles. The first part: the development of our country's urban law enforcement system has made a simple comb, from urban construction supervision, to relatively concentrated administrative punishment power and urban comprehensive administrative law enforcement. The third Plenary session of the 18 CPC Central Committee proposed a relatively centralized law enforcement power. Although urban construction supervision belongs to the administrative law enforcement department of urban construction, but understand the emergence and development of urban construction supervision system. It is helpful for us to better understand the evolution of urban management law enforcement system. The second part: the basic meaning of new urbanization, urban management law enforcement and fair and civilized law enforcement and the significance of fair and civilized law enforcement to promote the new urbanization. It provides the background and theoretical basis for the further study below. The third part discusses the reasons that affect the fair and civilized law enforcement of urban management in the process of new urbanization, and analyzes from three major directions, namely, the lack of urban management law enforcement system itself and the non-standard behavior of urban management law enforcement. The construction of administrative law enforcement team of urban management is backward, each direction is elaborated into several different aspects in detail. Part 4th: after fully reading the decision of the third Plenary session of the 18 CPC Central Committee on comprehensively deepening the reform of the urban management system, based on this, we should strengthen the top-level design and improve the law enforcement procedures. Strengthen the legal supervision of the three aspects of improving the urban management administrative law enforcement system, strengthening fair and civilized law enforcement put forward their own views, the top-level design respectively from the formulation of a special urban management law, reduce the administrative law enforcement levels. Strengthen the grass-roots law enforcement power, integrate the law enforcement main body, relatively centralized law enforcement power, straighten out the urban management law enforcement system, improve the law enforcement and service level four aspects are discussed. How to promote the relatively centralized law enforcement power is the difficulty and innovation point of this paper.
