警察街面执法治理的解释与完善

【摘要】：警察街面执法的治理取决于警察与执法对象的法律关系。运用法律手段进行治理需要依赖法律规范或科层监管机制来约束彼此的行为。事实上,警察往往不会首先诉诸法律与武力,而是会考虑柔性执法、策略执法,力求矛盾化解。警察街面执法的治理依赖"公序良俗"等社会共识、地方共识和部门共识的激励与监管,更多地依靠道德、义务、声誉、情感和信任等手段,其风险也显而易见。警察街面执法,不仅需要掌握各类正式规范与非正式准则,也需要对宏观社会结构、微观执法场景与对象有所了解。应整合程序化、专业化层面的治理和社会、组织层面的治理。
[Abstract]:The governance of police street law enforcement depends on the legal relationship between the police and the law enforcement object. The use of legal means to govern needs to rely on legal norms or regulatory mechanisms to restrain each other's behavior. Police often do not first resort to law and force, but will consider flexible law enforcement, strategic law enforcement, and strive to resolve contradictions. The governance of police street law enforcement depends on the "public order, good customs" and other social consensus. Incentives and regulation of local and sectoral consensus rely more on ethics, obligations, reputation, emotion and trust, the risks of which are also obvious. Not only need to master all kinds of formal and informal norms, but also need to understand the macro-social structure, micro-law enforcement scenarios and objects. Should integrate procedural, professional level of governance and society. Governance at the organizational level.
