我国国家安全委员会法律规制探析

【摘要】：十八届三中全会决定成立国家安全委员会。从十八大公告来看,“国家安全委员会主要职责是制定和实施国家安全战略,推进国家安全法治建设,制定国家安全工作方针政策,研究解决国家安全工作中的重大问题。”但国家安全委员会在我国属于全新成立的国家机构,虽工作职能与管辖范围与国家安全部有所重叠,但其如何定位、如何运作都值得研究,更应被纳入中央一再强调的社会主义法治体系。本文从国家安全委员会的定位、职责入手,对国家安全委员会法律规制进行探讨。认为我国的国家安全委员会是一个兼具领导职能、协调职能和咨询职能的综合性机构。因其行使国家安全方面的国家权力,涉及公民人权和国家的核心利益,应该受到法律的规制。笔者研究了包括美国、俄罗斯、日本、朝鲜等世界主要国家和地区的国家安全委员会设置情况及其法律规制情况,比较了不同国家的国家安全委员会成立、定性、运行、监管等方面问题。在借鉴外国经验的基础上,结合我国实际国情,得出了应从修改宪法、修改现行国家安全法以及制定国家安全委员会管理法等方面对其进行法律规制,在保障国家安全委员会合宪性及合法性的前提下,对其的构成、职责、运行方式和法律监督等具体方面做出规定,才能使我国的国家安全委员会健康、高效、有效的运行。
[Abstract]:The third Plenary session of the 18 CPC Central Committee decided to set up the National Security Committee. According to the 18 announcement, "the main responsibility of the National Security Council is to formulate and implement the national security strategy and promote the construction of the rule of law in national security." The National Security Council (NSC) is a newly established state body in our country to formulate guidelines and policies for the work of national security and to study and solve major problems in the work of national security. Although the functions and jurisdictions of work overlap with those of the Ministry of National Security, it is worth studying how they are located and how they operate. It should be included in the socialist legal system emphasized by the central authorities. This paper starts with the orientation and responsibility of the National Security Council. This paper probes into the legal regulation of the National Security Council and thinks that the National Security Council of our country is a leading function. The comprehensive agency of coordination function and advisory function should be regulated by law because it exercises the state power in national security and involves the human rights of citizens and the core interests of the country. The author has studied including the United States. Russia, Japan, Korea and other major countries and regions in the world of national security committee settings and legal regulations, compared the establishment of national security committees in different countries, qualitative, operational. Based on the experience of foreign countries and the actual situation of our country, the author draws a conclusion that the constitution should be revised. To modify the current national security law and to formulate the national security committee management law and other aspects of its legal regulation, in the premise of ensuring the constitutionality and legality of the national security committee, its composition and responsibilities. In order to make the NSC run healthily, efficiently and effectively, the operation mode and legal supervision should be stipulated.
