我国城市占道停车收费法律问题研究

【摘要】：占道停车是城市发展的必经阶段,收费是对占道行为的一种积极规范。国外多数国家,尤其是发达国家都经历了这一过程,并且结合实际较好的处理了其中存在的问题和矛盾。我国经济迅速发展,机动车保有量急速增长,但是停车设施建设却远落后于交通的需求,越来越多的城市出现了严重的乱停、乱放现象,加剧了城市交通拥堵,也导致占道停车纠纷日益增多。围绕城市占道停车是否应收费、依据什么收费、由谁来收取、收费的性质、收费后费用流向等问题及争议备受关注,也成为目前我国在城市占道停车收费上亟待解决的难题。占道停车是城市停车系统的重要组成部分,收费有利于缓解城市交通拥堵、解决停车位供缺矛盾、规范停车秩序,有利于维护公共资源和个人的权益,有利于促进城市经济发展。为规范停车秩序,改善交通拥堵应运用收费手段调整占道停车行为,拓展城市停车系统。本文通过对北京、苏州两个具有代表性的城市的占道停车收费现状进行梳理和研究,了解到我国城市占道停车收费目前存在的主要问题和争议,在认为占道停车收费是城市发展的趋势,收费有利于解决城市停车位供不应求的矛盾的基础上,分析了占道停车收费的合理性及合法性,并对国外城市占道停车收费进行考察,针对我国的实际情况从明确收费的法律依据、设置专属管理机构、完善定价程序、创新收费模式、实行收费资金专项使用制度、建立监督机制等方面提出了建议,以期从立法到具体的实际操作上规范我国城市占道停车收费,形成秩序化、法制化的城市占道停车收费制度。
[Abstract]:Occupy parking is a necessary stage of urban development, and charging is a positive criterion for the behavior of road Occupy. Most foreign countries, especially developed countries, have gone through this process. And in combination with the actual situation, the existing problems and contradictions are well dealt with. The rapid economic development of our country, the rapid growth of motor vehicle ownership, but the construction of parking facilities lags far behind the traffic demand. More and more cities appear serious random parking phenomenon, which exacerbates urban traffic jams and leads to more and more parking disputes. Around whether urban parking should be charged, on what basis, who will collect it? The nature of charging, the flow of fees after charging, and so on have attracted much attention, which has become a difficult problem to be solved in the urban parking system, which is an important part of urban parking system. Charging is conducive to alleviating urban traffic congestion, resolving the contradiction between the supply and shortage of parking spaces, standardizing parking order, safeguarding public resources and personal rights and interests, and promoting urban economic development. In order to improve traffic congestion, we should adjust the parking behavior and expand the urban parking system by means of charging fees. This paper combs and studies the current situation of parking charges in two representative cities of Beijing and Suzhou. On the basis of understanding the main problems and disputes existing in urban parking charges in China, it is considered that parking charges are the trend of urban development, and the charge is conducive to solving the contradiction that the demand for parking spaces in cities exceeds the demand for parking spaces. This paper analyzes on the rationality and legitimacy of parking charge in the lane, and investigates the parking charge in foreign cities. According to the actual situation of our country, it sets up the exclusive management organization and consummates the pricing procedure according to the actual situation of our country. Some suggestions are put forward from the aspects of innovating the charging mode, implementing the system of special use of charge funds, establishing supervision mechanism, and so on, in order to standardize the parking charge in cities of our country from legislation to practical operation.
