我国食品安全追溯法律制度研究

【摘要】：近年来,我国食品安全问题频发。毒奶粉、地沟油、苏丹红、瘦肉精等,一次次敲响了食品安全的警钟。而我国《食品安全法》中关于食品安全追溯制度并不完善,其它规范性法律文件的法律位阶较低,强制性规范缺失,缺乏有效的技术法规,现存的追溯监管体系又耗时费力,以致食品安全问题不能得到有效遏制。当今欧美诸国已建立相对完善的食品安全追溯法律制度,先进的食品安全追溯管理系统广泛应用于各类食品生产商、大型卖场、零售商以及食品监管部门。笔者试图通过对我国食品安全追溯法律制度的理论研究及现状分析,借鉴国外先进的经验和做法,以期完善我国现行食品安全追溯法律制度,切实保障居民生活食品安全。文章以食品安全追溯主体的权利和义务为主线来分析、研究我国的食品安全追溯法律制度,并针对不同的食品安全追溯主体提出相关立法建议。提出明确化的食品安全追溯管理原则、根据追溯主体的特征实行差异化管理、设立食品安全追溯过渡期、完善追溯主体的权利和义务、提高对食品安全追溯违法行为的处罚、完善食品惩罚性赔偿制度、实行食品安全追溯“引咎问责”制度、建立全国统一的食品安全追溯查询服务系统,强制相关食品领域企业实行电子监管码制度。
[Abstract]:In recent years, China's food safety problems frequently. Tainted milk, drainage oil, tonyred, clenbuterol, a wake-up call for food safety. But our country "food safety law > on food safety traceability system is not perfect and other normative legal documents and legal order is low, lack of mandatory norms, the lack of effective technical regulations, the existing traceability regulatory system is time-consuming, so that food safety problems cannot be effectively curbed. The European and American countries have established comparatively perfect legal system of food safety traceability, advanced food safety traceability management system is widely used in all kinds of food manufacturers, large stores, retailers and the food regulatory authorities. Through theoretical research and analysis of the status quo of China's food safety traceability system of law, learn from foreign advanced experience and practice, in order to improve our current food safety catch The legal system should be traced to ensure the safety of the living food of the residents.
The rights and obligations of the food safety traceability subject as the main line of food safety traceability system of law of our country, and put forward relevant legislative suggestions on food safety traceability in different subjects. Put forward the principle of food safety traceability management, according to the characteristics of the main body of the back differential management implementation, the establishment of food safety traceability transition period, improve the rights and obligations of the subject back to improve food safety traceability, illegal acts of punishment, perfection of punitive compensation system of food, food safety traceability "to implement accountability system, the establishment of food safety traceability inquiry service system of national unity, the implementation of electronic monitoring code system of compulsory food enterprises in the field.
