【摘要】：动物法律保护的逻辑起点关乎伦理问题,又关乎法律问题,通过对伦理学基础和法学基础分析,我国动物保护立法应采取动物福利立法模式;在国外,美国、澳大利亚、欧盟及其成员国的动物福利立法较为发达,在价值理念和具体制度上为我国动物福利立法提供了诸多经验;通过对我国动物保护相关立法现状的梳理,可知我国动物保护立法存在体系性缺失、内容滞后、保护范围狭窄、综合性动物福利立法缺位等不足或问题。对此,应当从价值追求、法律定位以及具体内容等方面不断构建并进一步完善我国动物福利立法
[Abstract]:The logical starting point of animal legal protection concerns both ethical and legal issues. By analyzing the basis of ethics and law, animal protection legislation in China should adopt the animal welfare legislation model; abroad, the United States, Australia, the United States, Australia, the United States of America, Australia, the United States of America, Australia, the United States, The European Union and its member states have developed animal welfare legislation, which has provided a lot of experience for China's animal welfare legislation in terms of value concept and specific system.
