我国集体协商中政府职能的立法反思与完善

【摘要】:通过整理与归纳有关集体协商的法律规定,总结出我国政府在集体协商中主要履行的职能有:监督职能、服务职能以及集体劳动争议的协调与处理职能。近年来,我国政府在集体协商运行中职能的发挥并不充分。究其原因,主要是立法上存在一些不足之处。本文立足于我国当前有关政府在集体协商中职能的法律规制现状,对完善相关法律规制提出一些改进建议,有利于政府依据法律规定更好的发挥职能,促进集体协商的开展,化解劳资矛盾。文章第一部分归纳与总结我国政府劳动行政部门在集体协商中的职能。并对各项职能的含义与内容展开具体分析。通过相关法律总结,政府的监督职能主要是监督集体协商规则的执行,监督协商的程序与结果。除此之外,还要监督企业在协商过程中是否存在仗势欺人等不当劳动行为。政府的服务职能指在政府对集体协商的进程进行间接调控,对劳资双方提供有助于其达成协议的各种信息、指导,并对集体协商制度进行广泛宣传与教育。政府的协调与处理职能指当双方发生冲突时,政府应当协调与处理双方间的矛盾冲突,引导双方进行协商,积极促进劳资双方签订集体合同。文章的第二部分主要分析我国关于政府在集体协商中职能相关立法的不足,及因立法不足导致政府在发挥职能过程中产生的问题。一些相关规定过于原则化,使政府在集体协商中监督职能定位不合理,行使权力不充分,缺少法律依据,甚至对权利进行滥用。监督职能存在的问题是程序不完善。服务职能缺少全国性立法,及地方立法目的定位不准。协调与处理职能存在的问题是政府缺少主动预防,协调处理方式缺少可操作性及启动程序相关规定原则化。文章的第三部分是对政府在集体协商中职能的法律定位进行立法完善。在监督职能上,应规范监督程序,建立政府与工会协作的法律监督体系,并完善审查意见书相关规定。我国应将服务职能纳入全国性立法,并明确服务职能的具体内容。在协调与处理职能上,建立劳动争议预防与应急处理机制,完善三方协调机制。
[Abstract]:By sorting out and summing up the legal provisions concerning collective negotiation, it is concluded that the main functions performed by our government in collective negotiation are: supervision function, service function and coordination and handling function of collective labor dispute. The function of our government in the operation of collective consultation is not sufficient. The main reason is that there are some deficiencies in legislation. This paper is based on the current legal regulation of the functions of government in collective consultation. To improve the relevant legal regulations and put forward some suggestions to improve the government in accordance with the provisions of the law to play a better role, to promote the development of collective consultation, The first part of the article summarizes and summarizes the functions of the labor administrative department of our government in collective negotiation, and carries out a concrete analysis of the meaning and content of each function. The supervisory function of the government is mainly to supervise the implementation of collective bargaining rules and the procedures and results of the negotiations. In addition, The service function of the government refers to the indirect regulation of the process of collective negotiation by the government and the provision of all kinds of information to the employers and employees to help them reach an agreement. The coordination and handling function of the government means that when there is a conflict between the two sides, the government should coordinate and deal with the conflicts between the two sides, and guide the two sides to negotiate. The second part of the article mainly analyzes the insufficiency of the legislation on the functions of the government in collective negotiation. Some related provisions are too principled, which makes the government's supervision function in collective consultation unreasonable, the exercise of power insufficient, and the lack of legal basis. Even abuse of power. The problems of supervision function are imperfect procedure, lack of national legislation for service function, and mispositioning of local legislative purpose. The problem of coordination and handling function is the lack of active prevention by the government. The third part of the article is to perfect the legal position of the function of the government in collective consultation. In the supervisory function, the supervision procedure should be standardized. Establish the legal supervision system of the cooperation between the government and the trade union, and perfect the relevant provisions of the review opinion. Our country should incorporate the service function into the national legislation, and clarify the specific content of the service function. Establish labor dispute prevention and emergency management mechanism, improve tripartite coordination mechanism.
