慈善组织行政监管立法研究

【摘要】：当今慈善事业的发展成为了衡量社会发展的重要标志,慈善组织是慈善事业的中坚力量。近年来,我国的慈善组织蓬勃发展起来,为了规范和促进慈善组织的发展,我国许多省市出台了规范和促进慈善组织发展的地方性法规,但是必须看到我国的慈善组织相关立法仍不完善,立法体系不统一,尤其是对慈善组织的行政监管的相关立法不完备。本文从行政法学角度出发尝试对慈善组织的行政监管进行研究,全文共分四个部分,第一部分从慈善组织行政监管的概念入手,对慈善组织的概念与特征,慈善组织行政监管的概念,慈善组织行政监管的理论基础进行了分析,阐述了慈善组织行政监管的基本理论；第二部分总结了截至2013年底,已经出台的慈善组织行政监管相关立法,归纳出我国慈善组织行政监管相关立法中已有的法律制度,找出我国慈善组织行政监管立法存在的主要问题；第三部分考察英国、美国、德国的慈善组织监管制度,分析上述各国慈善组织监管制度对我国慈善组织行政监管立法的启示；第四部分,针对第二部分论述的我国慈善组织行政监管立法存在的主要问题,给出立法建议。
[Abstract]:The development of charity has become an important symbol of social development, and charitable organizations are the backbone of charity. In recent years, charitable organizations in China have flourished, in order to standardize and promote the development of charitable organizations. Many provinces and cities in China have issued local laws and regulations to standardize and promote the development of charitable organizations. However, we must see that the relevant legislation of charitable organizations in our country is still imperfect and the legislative system is not unified. In particular, the relevant legislation on the administrative supervision of charitable organizations is not complete. This paper attempts to study the administrative supervision of charitable organizations from the perspective of administrative law. The paper is divided into four parts. The first part begins with the concept of administrative supervision of charitable organizations, and analyzes the concept and characteristics of charitable organizations. The concept of charity organization administrative supervision, the theoretical basis of charity organization administrative supervision are analyzed, and the basic theory of charity organization administrative supervision is expounded. The relevant legislation on the administrative supervision of charitable organizations has been introduced, summed up the existing legal system of the relevant legislation on the administrative supervision of charitable organizations in China, and found out the main problems existing in the legislation of administrative supervision of charitable organizations in China. The third part investigates the United Kingdom. The United States, Germany's Charitable Organization Supervision system, analyzes the above-mentioned countries charity organization supervision system to our country charity organization administrative supervision legislation enlightenment; 4th part, In the second part, the main problems in the legislation of administrative supervision of charitable organizations in China are discussed, and the legislative suggestions are given.
