城市房屋拆迁中政府依法行政问题研究

【摘要】：城市房屋拆迁是城市建设的重要一环,在城市发展中起着至关重要的作用,但是,在全国各地的实际操作过程中,城市房屋拆迁有时也变成了少数地方官员攫取自利并运用行政强制力实施的扰民工程或是意图获取升迁资本的“政绩工程”。目前,在拆迁中,因不严格依法行政而引发问题的占有较高比例。这都与当前构建和谐社会的形势不相协调。首先,对城市房屋拆迁与依法行政的相关法律和理论进行分析,具体包括城市房屋拆迁的基本含义、基本类型、法律法规；依法行政的相关概念和理论。其次,阐述我国房屋拆迁中不规范执法问题现状。包括两个部分,一是对房屋拆迁中违法行政的集中表现进行了概括,如相关法律、法规不完善,政府和开发商的利益趋同,政府单方面的话语权,强制拆迁、暴力拆迁局部地区表现突出等。二是通过对典型案例的分析,揭示现在地方房屋拆迁的现状以及出现的原因。再次,剖析城市房屋拆迁中出现政府不规范执法的原因。主要从法律法规规定不明晰,公共利益界限不明,政绩工程心态,行政权力异化,司法权弱化等方面进行了剖析。最后,对搞好城市房屋拆迁中政府依法行政问题提出对策思考。具体包括政府应确立依法拆迁理念,界定房屋拆迁中公共利益,取消行政机关的强制拆迁权,完善司法强制拆迁,完善监督机制等对策。
[Abstract]:Urban housing demolition is an important part of urban construction and plays a vital role in urban development. However, in the actual operation process of various parts of the country, Urban house demolitions have sometimes become "performance projects" that a handful of local officials have taken advantage of and used administrative coercion to carry out, or that they intend to acquire capital for promotion. At present, in demolition, A high proportion of problems are caused by not strictly administering according to law, which is not in harmony with the current situation of building a harmonious society. First of all, this paper analyzes the relevant laws and theories of urban housing demolition and administration by law, including the basic meaning, basic types, laws and regulations of urban housing demolition, and related concepts and theories of administration by law. Secondly, it expounds the current situation of irregular law enforcement in house demolition in our country. It includes two parts. One is to generalize the concentrated performance of illegal administration in house demolition, such as the imperfect laws and regulations, the convergence of interests between the government and the developer. Through the analysis of typical cases, the paper reveals the present situation and reasons of local house demolition. Thirdly, this paper analyzes the causes of the government's non-standard law enforcement in the urban housing demolition, mainly from the aspects of unclear laws and regulations, unclear boundaries of public interests, state of mind of performance engineering, alienation of administrative power, weakening of judicial power, and so on. Finally, some countermeasures are put forward to solve the problem of government administration according to law in the process of urban house demolition, including the government should establish the concept of legal demolition, define the public interest in house demolition, and cancel the compulsory removal right of administrative organ. Improve the judicial forced demolition, improve the supervision mechanism and other countermeasures.
