鞍山市劳动监察机构执法程序优化研究

【摘要】:当前我国市场经济发展迅速,劳动关系运行面临新的困难和挑战,劳动侵权案件频繁发生,这对我国的劳动监察体系提出了新的要求,劳动监察的发展必须紧跟时代步伐,与时俱进。面对新时代的新要求,劳动监察执法流程优化势在必行,劳动监察“两网化”管理模式的提出为法制社会建设提供了一种全新的理论。劳动保障监察势必要创新监察手段,优化执法流程,实行两网化管理模式。劳动保障监察“两网化”管理模式即网格化管理和网络化管理,它以“分片包干、主动监管、上下协同、动态监控”为主要特点。网格化管理是指把所管辖的区域按照一定的规律划分为若干网格,各网格配备一定的劳动保障协管员,采集网格内用人单位的基本信息,及时了解和指导用人单位依法用工。网络化管理是指利用现代化的网络技术,搭建用人单位监管信息平台,根据各级网格提供的基础数据,汇总企业的用工信息,统一指挥执法力量。两网化管理平台的运行,能够有效的整合和发挥现有执法力量的作用,有效扩充劳动监察执法队伍,使监察执法更加靠近企业、贴近劳动者,有效维护劳动者的合法权益,服务企业良性发展、维护社会稳定和谐。 本文围绕鞍山市劳动监察执法流程优化展开,,详细地分析了鞍山市劳动监察目前面临的困境,亟需解决的问题。通过比较分析法,实证分析法,调研数据分析等分析方法,论证鞍山市劳动监察执法流程优化即“两网化”管理模式的实施的意义和具体实施方法。 鞍山市劳动监察体系不够完善,执法理念陈旧,不能解决新时期劳动监察提出的全新课题,需要继续加深制度和队伍建设,在今后的劳动监察发展革新的过程中要不断探索创新,确保劳动相关法律法规得以落实。本文在研究劳动保障执法程序优化的一些基本原理的基础上,详细分析劳动监察执法程序优化的内容和特点,以及我国劳动保障“两网化”的运行方法和构架。在此基础上分析了鞍山市目前劳动保障监察现状,主要执法流程,以及劳动监察执法程序优化的方式方法。同时仔细分析了劳动监察程序优化,两网化管理办法实施的重要意义。通过案例分析等方法,详细分析了劳动监察执法程序优化的具体措施和成果。劳动监察执法程序优化暨劳动监察两网化管理的推行必将推动鞍山市劳动监察执法效能的提升。
[Abstract]:At present, China's market economy is developing rapidly, the operation of labor relations is facing new difficulties and challenges, and the cases of labor infringement occur frequently, which puts forward new requirements to the labor supervision system of our country, and the development of labor supervision must keep pace with the times. In the face of the new requirements of the new era, it is imperative to optimize the process of labor supervision and law enforcement. The "two networks" management mode of labor supervision provides a new theory for the construction of a legal society. Labor security supervision must innovate the means of supervision and optimize the process of law enforcement. The "two nets" management mode of labor security supervision is grid management and network management, which is "divided into pieces, actively supervised, coordinated up and down". The main characteristic of dynamic monitoring is that the area under the jurisdiction is divided into several grids according to certain rules, and each grid is equipped with certain labor security wardens to collect the basic information of the employing units in the grid. Network management refers to the use of modern network technology to set up an employer supervision information platform, and to aggregate the employment information of an enterprise according to the basic data provided by grid at all levels, The operation of the two web-based management platforms can effectively integrate and play the role of existing law enforcement forces, effectively expand the labor supervision and law enforcement team, and make supervision and law enforcement closer to enterprises and workers. Effectively safeguard the legitimate rights and interests of workers, serve the healthy development of enterprises, and maintain social stability and harmony. This paper focuses on the optimization of the law enforcement process of the labor supervision in Anshan city, and analyzes in detail the difficulties faced by the labor supervision in Anshan city and the problems that need to be solved. Through comparative analysis, empirical analysis, investigation data analysis and other analytical methods, This paper demonstrates the significance and concrete implementation method of the management mode of "two networks" in Anshan City, where the process of labor supervision and law enforcement is optimized. Anshan City labor supervision system is not perfect, the law enforcement idea is old, can not solve the new task put forward by labor supervision in the new period, need to continue to deepen the system and team construction, In the process of the development and innovation of labor supervision in the future, we should constantly explore and innovate to ensure the implementation of labor related laws and regulations. This paper analyzes in detail the content and characteristics of the optimization of labor supervision law enforcement procedure, as well as the operation method and framework of "two networks" of labor security in our country. On this basis, it analyzes the present situation of labor security supervision in Anshan City, and the main law enforcement process. And the ways and means of optimizing the procedures of labor supervision and law enforcement. At the same time, it carefully analyzes the important significance of the optimization of labor supervision procedures and the implementation of the two network management methods. This paper analyzes in detail the concrete measures and achievements of the optimization of the labor supervision law enforcement procedure. The optimization of the labor supervision law enforcement procedure and the implementation of the two networks of labor supervision management will certainly promote the improvement of the efficiency of the labor supervision law enforcement in Anshan city.
