我国警察武器使用权制度研究

【摘要】：警察武器使用权是指人民警察为了履行职责,依法对他人使用武器的权力,是警察权的一种特殊表现形式,具有执法权的实质,是警察制止违法犯罪、保护公民人身财产及公共财产安全的武力手段。相对武器使用权的重要性,我国现有的武器使用权制度却明显滞后,体现为相关法律法规立法位阶太低,武器使用主体和客体不明确,使用条件标准不易掌控,审核监督机制不完善,等等。因此,借鉴境外先进立法和司法经验,完善我国武器使用权立法,是保证警察合法使用武器的重要基础。除引言与结语外,本文共有四个部分：第一部分对警察武器使用权进行概括分析,阐述了警察武器使用权的相关概念特征,并分析警察武器使用权的内容包括使用权主体、使用权客体、使用内容、使用条件、武器使用权的审核监督和相关保障制度。第二部分针对境外警察武器使用权制度的发展情况,研析了美国、英国、中国香港等地的警察武器使用权制度的发展情况。美国由于法律规定居民可以合法持枪,所以警察武器使用权法律法规相对发展的早,也比较成熟；英国采取的是文职警察和授权武装警察分立的模式,对武器使用的主体有了比较规范明确的界定；中国香港在武器管理、使用和事后保障方面有非常明确具体的规定。第三部分分析了我国警察武器使用权制度的立法现状和不足。我国武器使用权立法主要体现宪法、法律、行政法规、部门规章、司法解释等方面,但存在着立法位阶问题、使用主体不够明确、使用客体不易判明、使用武器的内容不明确、使用武器条件标准不易掌控、审核部门与监督部门众多、用后保障空缺等问题。第四部分对我国警察武器使用权制度的完善提出了建议。依托系统论、信息论、控制论的指导理论,在提升我国警察使用武器专门法律的位阶、明确武器使用权的归属、明确使用客体、对使用武器的行为进行分层级明确、对使用武器条件标准进行细化、规范审核部门与监督部门、重视用后保障相关制度等方面完善我国警察武器使用权制度的立法。
[Abstract]:The right to use a police weapon is the power of the people's police to use weapons against others in accordance with the law in order to perform their duties. It is a special manifestation of the power of the police, which has the essence of the power to enforce the law. Relative to the importance of the right to use weapons, the current system of the right to use weapons in our country is obviously lagging behind, which is reflected in the low level of relevant laws and regulations. The subject and object of weapon use are not clear, the standard of using condition is not easy to control, the mechanism of audit and supervision is not perfect, and so on. In addition to the introduction and conclusion, there are four parts in this paper: the first part gives a general analysis of the right to use the police weapons, and expounds the relevant conceptual characteristics of the right to use the weapons. And analyzes the contents of the right to use of police weapons, including the subject of the right to use, the object of the right to use, the content of use, the conditions of use, The second part focuses on the development of the weapons use right system for overseas police officers, and analyzes the United States, the United Kingdom, the United States, the United Kingdom, the United States, the United Kingdom, the United States and the United Kingdom. There are very clear and specific provisions in terms of use and ex post protection. The third part analyzes the current legislative situation and deficiencies of the police weapons use right system in China. The legislation on the right to use weapons in our country mainly embodies the Constitution, laws, administrative regulations, departmental regulations, In judicial interpretation and other aspects, however, there are problems of legislative rank, the use of the subject is not clear enough, the use of the object is difficult to identify, the content of the use of weapons is not clear, the standard of the use of weapons is not easy to control, and there are many auditing and supervising departments. Part 4th puts forward some suggestions on the perfection of the system of police weapon use right in China. Relying on the guiding theory of system theory, information theory and cybernetics, it is promoting the rank of special law on the use of weapons by police in our country, which is based on the guidance theory of system theory, information theory and cybernetics. Defining the ownership of the right to the use of weapons, defining the objects of use, classifying the use of weapons into different levels, refining the criteria for the conditions of use of weapons, standardizing the auditing and auditing departments and supervising departments, Emphasis should be placed on the legislation of the police weapon use right system in China.
