索镇土地改革相关法律问题研究（1946-1950）

【摘要】：解放战争时期,中国共产党带领解放区群众进行了一场轰轰烈烈的土地改革运动。这场土地改革不仅对当时的中国社会产生了深刻的影响,而且也对当今的法治建设及农村土地制度的改革有着重要启示。索镇的土地改革是整个土地改革蓝图的重要组成部分,其实施是以中央到地方制定的一系列土改法律、政策为依据的,故索镇的土改过程实际上是一个执行土改法律、政策的过程。本文即是对索镇落实上级政策法令,实施土地改革的实际情况进行研究。全文共分为四个部分：第一部分,主要介绍了索镇土地改革的历史背景,包括索镇的基本情况,土改前农村土地的占有和使用情况,土改前的群众运动等。第二部分,论述了索镇实施土地改革所依据的法律、政策及索镇落实这些法律、政策的实际情况。土地改革初期的法律和政策主要包括：中共中央颁布的“五四指示”,中共华东中央局发出的“九一指示”和山东省政府颁布的《山东省土地改革暂行条例》；土改复查阶段的法律和政策主要包括：中共华东中央局制定的“二二一指示”和“七七指示”；土改结束阶段的法律和政策主要包括《中国土地法大纲》及其他法律、政策,如《在不同地区实行土地法的不同策略》、《一九四八年的土地改革和整党工作》、《纠正土地改革宣传中“左”倾错误》及中共华东局颁布的《中共华东中央局关于执行中央一九四八年土改与整党工作指示的报告》等。第三部分,主要论述索镇贯彻土改政策法令,实施土地改革的具体情况。这一部分主要包括：党组织对土地改革的领导,基层政权与群众组织执行土改任务的情况,阶级成份的划分情况以及土地、浮财的分配情况。第四部分,总结索镇土地改革过程中的经验和教训,分析对我国法治建设的影响,寻找对解决我国当前土地问题的启示。
[Abstract]:During the Liberation War, the Communist Party of China led the masses of the liberated areas in a vigorous land reform movement, which not only had a profound impact on Chinese society at that time, It also has important implications for the construction of the rule of law and the reform of the rural land system.
