社会力量科技奖励的法律规制

【摘要】：社会力量设立科技奖励作为政府设奖的有力补充,已成为我国科技奖励的重要组成部分,对于引导和推进技术进步、人才培养和产业发展,都发挥着极为重要的作用。但是目前与科技奖励相关的法律法规,都以政府设奖为主要内容,对社会力量设奖少有涉及,社会力量设奖的发展面临障碍,依靠社会力量设奖自身已难以打破困境,亟需对其进行法律规制。本文致力于探讨社会力量设奖的法律规制,具体包括：完善相关立法,包括实体性法律和程序性法律；明确行政管理主体的权利和义务,以提供支持和帮助为目的,以监督管理为手段,保障社会力量设奖良性发展；打造崇尚科学技术的社会大环境,引导社会力量设奖走向法制化、规范化。本文着眼于我国社会力量设奖的现状,借鉴国外成功经验,给出了切实可行的对策,力求对社会力量设奖有所助益。
[Abstract]:The establishment of scientific and technological awards by social forces as a powerful supplement to government awards has become an important part of our country's scientific and technological awards, which has served to guide and promote technological progress, talent training and industrial development. Both play an extremely important role. But at present, the laws and regulations related to the award of science and technology all take the government award as the main content, and rarely involve the establishment of awards for social forces, and the development of the awards for social forces is facing obstacles. It is difficult to break down the predicament by relying on the social force to set up the prize itself, so it is urgent to regulate it. This article is devoted to discussing the legal regulation of the social force award, including: perfecting the relevant legislation, including substantive law and procedural law; To make clear the rights and obligations of administrative subjects, to provide support and help, to ensure the healthy development of social forces by means of supervision and management, to create a social environment that advocates science and technology, This paper focuses on the present situation of social force awards in China, draws lessons from the successful experience of foreign countries, and puts forward practical countermeasures to help the establishment of awards for social forces.
