论我国非诉行政执行救济制度的构建

【摘要】：非诉行政执行是我国行政强制执行制度的重要组成部分，它以国家强制力为基础保障行政行为的最终实现。由于缺乏统一的立法规定，我国现行非诉行政执行救济制度存在诸多问题。“无救济则无权利”，，这一句古老的谚语道出了救济与权利的关系以及救济的必要性。本文试图从非诉行政执行的基本概念入手，分析我国相关执行救济制度的立法现状和理论主张，剖析我国现行执行救济制度存在的问题，借鉴民事执行救济制度的有益成果，提出了构建我国非诉行政执行救济制度的建议。本文共分为四个部分，各部分的主要内容是：第一部分是非诉行政执行救济制度概述。该部分是全文的理论基础，包括了非诉行政执行的概念、性质，非诉行政执行救济制度的概念、范围等内容。第二部分是我国非诉行政执行救济制度的立法现状。该部分对我国现行立法中存在的相关救济制度进行了论证，通过对执行复议、听证、执行异议、异议之诉等具体救济制度的剖析，发现执行救济制度在立法上的闪光点和存在的问题。第三部分是有关我国非诉行政执行救济制度的理论主张。该部分对我国理论界有关非诉行政执行救济制度的理论主张进行了论述。其中，着重对执行诉讼、上诉、检察监督等几个具有代表性的救济制度主张进行了评析。最后一部分是构建我国非诉行政执行救济制度的建议。该部分是本文的核心内容，也是本文的研究目的所在。在该部分中，首先确立了构建我国非诉行政执行救济制度应秉承的原则，搭建了非诉行政执行救济制度的框架。其次，通过对听证制度、执行复议、执行异议、异议之诉等具体救济制度的阐述提出了构建我国非诉行政执行救济制度的具体建议。
[Abstract]:Non-litigation administrative execution is an important part of the administrative enforcement system in China. It guarantees the ultimate realization of administrative action on the basis of national coercive force. There are many problems in the current relief system of non-litigation administrative execution in our country. "No remedy means no right". This ancient proverb reveals the relationship between relief and right and the necessity of relief. This paper attempts to start with the basic concept of non-litigation administrative execution. This paper analyzes the current legislative situation and theoretical propositions of the relevant enforcement relief system in China, analyzes the problems existing in the current enforcement relief system of our country, and draws lessons from the beneficial results of the civil enforcement relief system. Some suggestions are put forward to construct the relief system of non-litigation administrative execution in our country. This paper is divided into four parts, the main content of each part is:. The first part is an overview of the relief system of non-litigation administrative execution, which is the theoretical basis of the full text, including the concept, nature, concept and scope of non-litigation administrative execution relief system. The second part is the legislative status of the relief system of non-litigation administrative execution in China. This part demonstrates the existing relief system in the current legislation of our country, through the executive reconsideration, hearing, execution objection, The analysis of the specific relief system, such as dissent lawsuit, finds out the glittering point and existing problems in the legislation of executive relief system. The third part is about the theory of non-litigation administrative enforcement relief system in China. This part discusses the theory of non-litigation administrative enforcement relief system in our country. Procuratorial supervision and other representative relief system proposals were evaluated. The last part is the suggestion of constructing the relief system of non-litigation administrative execution in our country. This part is the core content of this paper, and is also the purpose of this paper. First of all, it establishes the principle of constructing the relief system of non-litigation administrative execution in our country, and sets up the framework of the relief system of non-litigation administrative execution. Secondly, through the hearing system, the execution of reconsideration, the execution of dissent. The specific relief system, such as dissent action, is expounded, and some concrete suggestions are put forward to construct the relief system of non-litigation administrative execution in our country.
