东莞市若石沐足中心停业整顿的法律分析

【摘要】：2014年2月9日,央视《新闻直播间》曝光东莞市多个娱乐场所存在色情服务的违法行为后,社会开始对东莞扫黄加以议论,学界开始对东莞扫黄过程中的相关法律问题展开讨论,本文选取了具体某一娱乐场所作为典型,希望对其在扫黄行动中被责令停业整顿的相关法律问题进行研究,从而找出相关处置建议。责令停业整顿作为一种相对严重的行政处罚行为,对其性质和法律归属进行研究,有利于规范行政处罚行为,推动依法行政的进程。本文第一章主要对案件的由来及停业整顿的内容加以陈述,为接下来对责令停业整顿的法律分析作好铺垫;第二章主要是对责令停业整顿的法律性质加以分析,通过对学界各种学说的分析以及与相关概念的比较,明确责令停业整顿的法律属性;第三章主要对若石沐足中心被责令停业整顿中存在的法律问题进行分析,主要从立法、程序等方面分析其存在的问题,为处置建议的提出埋下伏笔;本文最后一章是提出若石沐足中心停业整顿的法律处置建议,主要从确立责令停业整顿的基本原则、加强程序控制以及完善救济制度等几个方面加以把握。
[Abstract]:In February 9th 2014, after CCTV's "News Live Room" exposed the illegal practices of pornographic services in many entertainment places in Dongguan, the society began to comment on the elimination of pornography in Dongguan. Academic circles began to discuss the relevant legal issues in the process of eliminating pornography in Dongguan. This paper selected a specific entertainment place as a typical example, hoping to study the relevant legal issues in which it was ordered to suspend business and rectify in the anti-pornography operation. As a relatively serious act of administrative punishment, the study of its nature and legal attribution is conducive to standardizing administrative punishment. The first chapter describes the origin of the case and the contents of the closure of the rectification, which will pave the way for the legal analysis of the order to suspend the business. The second chapter mainly analyzes the legal nature of the order to suspend business rectification, through the analysis of various theories in academic circles and the comparison with the related concepts, the legal attributes of the order suspension rectification are made clear. The third chapter mainly analyzes the legal problems existing in the suspension of the operation of Ruoshi foot Mushou Center, mainly from the aspects of legislation, procedure and so on, so as to lay the groundwork for the proposal of disposal. The last chapter of this paper is to put forward some suggestions on the legal treatment of the closure of the Shishi foot Center, mainly from the following aspects: establishing the basic principles of ordering the suspension and rectifying, strengthening the procedural control and perfecting the relief system.
