商会的自治权研究

【摘要】：近些年我国经济发生了翻天覆地的变化，与此同时，各种类型的商会组织也蓬勃兴起。这些商会组织在加强各企业联系、规范行业自治、信息资源共享、促进经贸交流等方面发挥了巨大作用。众所周知，商会是自愿发起的非营利组织，享有相应的权限和承担一定的义务，但在如今日新月异的新经济环境下，商会的部分职能和权限也伴随着更好地服务企业和服务社会的目的而应运而变。所以，在复杂的经济和商业环境下，在新商会源源不断设立，，旧商会蓬蓬勃勃改革的形势下，怎样规范商会地位和职能变得至关重要起来，而商会的权限中，自治权尤为核心。本文首先概述了商会的现状以及近些年的变迁，接着进而阐述到商会的权力，引述到核心的商会自治权，从自治权的内容，效力，意义等方面来具体阐释。结合一定案例，将国内商会和西方较先进的商会模式进行横向比较，将这些年商会的改革，尤其是自治权的发展演进和以前商会初期发展时期进行纵向比较，总结分析得出商会自治权的优势和弊端，给予我国立法在规制商会的法律法规方面提供建议，为我国商会的下一步发展提供新思路。
[Abstract]:In recent years, China's economy has undergone earth-shaking changes, and at the same time, various types of chamber of commerce organizations have flourished. These chambers of commerce organizations are strengthening business ties, standardizing industry autonomy, and sharing information resources. Promoting economic and trade exchanges has played a great role. As we all know, the Chamber of Commerce is a voluntary non-profit organization with corresponding powers and obligations, but in today's rapidly changing new economic environment, Some of the functions and powers of the Chamber of Commerce have also changed with the aim of better serving enterprises and serving the society. Therefore, in a complex economic and commercial environment, with the continuous establishment of new chambers of commerce and the vigorous reform of the old chambers of commerce, How to regulate the status and function of chamber of commerce becomes very important, and autonomy is the core of the power of chamber of commerce. This paper first summarizes the current situation of the Chamber of Commerce and the changes in recent years, then expounds the power of the Chamber of Commerce, and quotes the core autonomy of the Chamber of Commerce, which is explained in detail from the aspects of the content, effect and significance of the autonomy. Comparing the domestic chamber of commerce with the more advanced chamber of commerce in the West horizontally, and comparing the reform of the chamber of commerce in these years, especially the evolution of autonomy, with the early development period of the previous chamber of commerce. Through summing up and analyzing the advantages and disadvantages of the autonomy of the Chamber of Commerce, this paper gives advice to the legislation of our country in regulating the laws and regulations of the Chamber of Commerce, and provides a new way of thinking for the further development of the Chamber of Commerce in China.
