交通管理中的行政强制措施研究

【摘要】：交通管理中的行政强制措施，又称交通警察行政强制措施，是公安交警为了实施有效的交通行政管理所必不可少的手段和经常使用的措施，对交通管理行政目的的实现发挥了非常重要的作用。但是在目前的执法环境下，，交通管理中的行政强制措施的实施效果却不尽如人意。本文以基层交警部门执法实践为切入口，总结交通管理中的行政强制措施以下突出问题：一是立法层面设定行政强制措施混乱、名称使用不规范；二是实施行政强制措施时，由于缺乏法律支撑，导致交警不能充分履行职责；三是存在滥用行政强制措施现象，侵害交通管理相对人合法权益。鉴于此，笔者通过对2012年《行政强制法》实施以来中交通管理执法难点和真实案例进行分类评析，归纳出当前交通管理中的行政强制措施不完善的背后所存在的深层次原因。并在此基础上，从规范行政强制措施的设定、完善立法引起的实施程序难题、改进行政强制措施实践中的具体操作办法三个方面提出完善交通管理中的行政强制措施建议，以期对规范交通警察行政强制措施有所助益。
[Abstract]:The administrative coercive measures in traffic management, also known as the administrative coercive measures of traffic police, are the necessary means and measures frequently used by the traffic police in order to implement effective traffic administration.It plays a very important role in the realization of the administrative purpose of traffic management.However, in the current law enforcement environment, the enforcement effect of administrative coercive measures in traffic management is not satisfactory.Taking the law enforcement practice of traffic police departments at the grass-roots level as the entry point, this paper summarizes the following outstanding problems of administrative coercive measures in traffic management: first, the confusion of administrative coercive measures at the legislative level, and the non-standard use of names; second, when implementing administrative coercive measures,Due to the lack of legal support, traffic police can not fully perform their duties; third, there is abuse of administrative coercive measures against the legitimate rights and interests of traffic management counterpart.In view of this, the author classifies the difficulties and real cases of traffic management enforcement since the implementation of the 2012 Administrative compulsory Law, and concludes the deep reasons behind the imperfection of administrative enforcement measures in current traffic management.On this basis, from three aspects of standardizing the setting of administrative coercive measures, perfecting the implementation procedure problems caused by legislation, and improving the concrete operation methods in the practice of administrative coercive measures, the paper puts forward some suggestions for perfecting the administrative coercive measures in traffic management.In order to standardize the traffic police administrative coercive measures are helpful.
