传统法文化视阈下农村女性土地权益保护研究

【摘要】：农村女性土地权益遭受侵害是当代社会普遍存在的现象。从某种意义上讲,该现象体现了国家法与传统法之间的博弈。无论是出嫁女、丧偶女还是离婚女、招赘女,其土地权益受侵害均可以从传统法上找到根源。保护农村女性土地权益,需要正视当代农村依旧受到传统法文化影响的现实,需要提高农民在村规民约制定过程中的参与度,强化调解手段在处理土地纠纷中的作用,建立有性别视角的农村土地承包经营权制度以及发展土地交易平台等。
[Abstract]:It is a common phenomenon in contemporary society that rural women's land rights and interests are infringed upon.In a sense, this phenomenon reflects the game between state law and traditional law.Whether they are married, widowed or divorced, their land rights and interests are infringed by traditional law.To protect the rural women's land rights and interests, we should face up to the reality that the contemporary countryside is still affected by the traditional law culture, enhance the farmers' participation in the process of making the village rules and regulations, and strengthen the role of mediation in the settlement of land disputes.Establish the rural land contractual management system with gender perspective and develop land trading platform.
