南宁市物业专项维修资金法律规则探究

【摘要】：南宁市作为我国准二线城市,在物业公共部分的“养老金”——物业专项维修资金的使用中存在范围不明晰、决策程序操作难,资金续缴规定抽象等问题,基于以上情况,本文从南宁市物业专项维修资金相关法律规则的规定与实际运行情况出发,结合国内各地方,规则制定、规则运行中的有益经验,针对性提出“双向列举制”、区分额度的决策程序前置制、分期续缴与全额续缴混合制等建议,安排写作结构如下:第一部分在理清我国住宅专项维修资金制度现状的基础上,阐述研究南宁市物业专项维修资金制度的必要性、可行性;第二部分从四个方面对南宁市使用物业专项维修资金过程中暴露的现有规则的主要问题举例并分析;第三部分针对前述问题,结合其他地市有益立法经验,进行深入论证,从突出实践操作的角度提出完善南宁市物业专项维修资金法律规则的对策。本文重点针对《南宁市物业专项维修资金管理办法》展开研究,对于南宁市近期将出台的“南宁市物业专项维修资金管理办法实施细则”具有一定意义,也是我国维修资金法律规则研究进程中的一次实践探索,以期为国家进一步出台更科学的相关规则提供有益思路。
[Abstract]:Nanning, as a quasi-second-tier city in our country, has some problems in the use of "pension" in the public part of property, the use of property special maintenance funds, the difficulty of operating decision-making procedures, and the abstract provisions for the continued payment of funds, etc., based on the above situation.Based on the rules and regulations of Nanning property special maintenance fund and its actual operation, combined with the beneficial experience in making rules and operating rules in all parts of China, this paper puts forward the "two-way enumeration system".Some suggestions, such as the pre-system of decision procedure for distinguishing quota, the mixed system of installment renewal and full payment, are arranged as follows: the first part is on the basis of clarifying the present situation of housing special maintenance fund system in our country.This paper expounds the necessity and feasibility of studying the fund system of special property maintenance in Nanning. The second part illustrates and analyzes the main problems of the existing rules exposed in the process of using the fund for the special maintenance of property in Nanning from four aspects.The third part aims at the above-mentioned question, unifies the other cities beneficial legislation experience, carries on the thorough demonstration, from the prominent practice operation angle proposed the consummation Nanning property special maintenance fund legal rule countermeasure.This paper focuses on the "Nanning City property Special maintenance Fund Management measures" research, Nanning City will be issued in the near future "Nanning property special maintenance fund management rules" has a certain significance.It is also a practical exploration in the research process of the legal rules of maintenance fund in China, in order to provide useful ideas for the country to further issue more scientific related rules.
