论我国公租房退出的地方立法

【摘要】:在2014年的两会期间,国务院总理李克强同志在政府工作报告中强调,今年将加大保障性安居工程建设力度。逐渐将更多的精力投入到保障房建设领域。房价的不断攀升给人们带来了这样那样的问题,住房问题不仅是世界性的难题,也是我国面临的主要问题之一。住宅权作为公民的基本人权,政府有责任也有义务让公民得到保障,使公民有尊严的活着。同时,帮助解决我国中低下收入人群的住房问题也是政府的基本责任。从2010年开始,我国逐步开始了大规模的公租房建设,以满足中低下收入人群的住房需求。因此,公租房的保障功能也就凸显出来,它的主要目的是为了解决城市新就业的职工、年轻毕业大学生以以及进城务工人员等群体的住房困难。公租房是产权公有房屋,它的租金一般是要低于市场租金的,同时公租房也是我国住房保障体系中的重要组成部分。然而,从实际中可知,空缺的法律制度和不完善的政策措施使得我国公租房实际运行效果不佳。中央立法的缺失,地方立法的混乱无不在敲响公租房立法的警钟。我国公租房退出环节力量薄弱、制度不完善导致公租房未能真正实现其保障性住房的意义。因此,本文的研究目的旨在通过对各地公租房在退出方面的立法研究,提出对我国公租房地方立法的完善建议。本文根据经济发展水平和地域分别选取了我国一、二、三线十个城市的公租房退出方面的立法规定,用表格的形式将退出的立法规定进行了列举梳理,,从梳理中得出了公租房退出的地方立法存在的问题并分析,最后对公租房退出的地方立法提出了完善建议。 公租房制度的施行主要依靠政府,因此首先就要确保公租房制度的执行有法可依,而公租房退出作为整个公租房运行环节中重要而关键的一环,立法的缺失及相关政策的粗糙导致公租房保障性功能无法顺利实现。文章旨在抛砖引玉,希望为完善我国公租房的地方立法贡献绵薄之力。
[Abstract]:During the two sessions in 2014, Premier Li Keqiang stressed in his government work report that efforts will be made to strengthen the construction of affordable housing projects this year. Gradually put more energy into indemnificatory apartment construction field. The rising housing prices have brought people one kind of problem, housing problem is not only a worldwide problem, but also one of the main problems facing our country. As the basic human rights of citizens, the government has the responsibility and obligation to ensure the citizens to live with dignity. At the same time, it is the basic responsibility of the government to help solve the housing problem of the middle and low income groups in our country. Since 2010, our country has started the large-scale public rental housing construction step by step to meet the housing demand of the middle and low income groups. Therefore, the security function of public rental housing is also prominent, its main purpose is to solve the housing difficulties of the new employment workers, young college graduates and migrant workers and other groups. Public rental housing is a property right public housing, its rent is generally lower than the market rent, at the same time, public rental housing is also an important part of our housing security system. However, it can be seen from the reality that the lack of legal system and imperfect policy measures make the actual operation of public rental housing ineffective. The absence of central legislation and the confusion of local legislation are ringing alarm bells of public rental housing legislation. The withdrawal link of public rental housing in China is weak and the system is not perfect, which leads to the failure of public rental housing to realize the significance of its indemnificatory housing. Therefore, the purpose of this paper is to put forward some suggestions to improve the local legislation of public rental housing in China through the legislative research on the withdrawal of public rental housing. According to the level and region of economic development, this paper selects the legislative provisions on the withdrawal of public rental housing in 10 cities in the first, second and third tier of our country, and enumerates the legislative provisions of the withdrawal in the form of tables. From combing out of the local legislation of public rental housing exit problems and analysis, finally on the public rental housing exit local legislation put forward some suggestions. The implementation of the public rental housing system mainly depends on the government, so it is necessary to ensure that the implementation of the public rental housing system has laws to follow, and public rental housing withdrawal is an important and key link in the whole public rental housing operation. The lack of legislation and the roughness of related policies lead to the public rental housing security function can not be successfully realized. The purpose of this article is to contribute to the improvement of local legislation on public rental housing.
