论机动车交通事故损害赔偿责任主体

【摘要】:从20世纪开始以来的世界各国机动车损害赔偿的立法发展历程来看,有关机动车交通事故损害赔偿责任主体研究一直是非常重要的问题,也是令立法者颇感头疼的问题。改革开放后,伴随随着我国社会主义市场经济的发展,消费者购买机动车能力的提高导致机动车增加率与日俱增,同时由于机动车的交通事故而给广大的人民造成了巨大的人身伤害和财产损失,由此引发的机动车交通事故损害赔偿纠纷已经成为急需解决的严重的社会问题。在机动车交通事故损害赔偿中,责任主体的认定呈现出多样性与复杂性的特点。在实践中,对机动车享有使用权、支配权和收益权的人员范围非常广泛,赔偿责任主体既可以是机动车的登记所有人或实际管理人,也可以是机动车的质权人、承租人、借用人、挂靠人,个别情况下还有可能是抢劫者、盗车者等等。同时在交通事故中受到伤害的往往是自然人,属于相对弱势群体,为了保证受害人得到更好、更快捷的救济,我们必须厘清不同法律关系中的赔偿责任主体。目前在中国,关于机动车交通事故损害赔偿责任主体的立法规定混乱,各地方的司法实践做法也不统一,这给司法实务带来了巨大的困难。本文旨对机动车交通事故损害赔偿责任主体的一些理论问题予以探讨,着重讨论了目前在理论界居于主导地位的运行支配和运行收益理论,并对实践中比较特殊的损害赔偿责任主体认定的情况进行类型化分析。本文除引言部分,共分为四章。 引言部分:主要阐明机动车交通事故损害赔偿责任主体认定的法律意义。 第一章:机动车交通事故损害赔偿责任主体概述 本章主要是探讨了机动车交通事故损害赔偿责任主体的概念。同时对机动车交通事故损害赔偿责任主体与道路交通事故责任主体的概念进行了区分 第二章:机动车交通事故损害赔偿责任主体的认定标准及归责原则 有关交通事故损害赔偿责任主体的认定标准,,在理论上有三种责任根据:危险分担理论、报偿责任理论、危险责任理论。在归责原则方面不但介绍了归责原则的历史变革,还阐释了不同学者关于此问题的观点。主要有无过错责任说、过错责任说和混合归责原则说。 第三章我国有关机动车交通事故损害赔偿责任主体的立法现状 介绍《民法通则》、《道路交通事故处理办法》、《道路交通安全法》、《侵权责任法》、《合同法》等法律、法规的机动车交通事故损害赔偿责任主体的相关规定。 第四章:机动车交通事故损害赔偿责任主体的类型化研究 正因为现在社会关系日趋复杂,因此导致机动车交通事故损害赔偿案件的责任主体问题具有复杂性和广泛性的特点。限于篇幅有限,在文章的第四部分,介绍了八种特殊类型的机动车交通事故损害赔偿责任主体主要包括:1、未转移机动车所有权登记情形;2、分期付款买卖情形;3、挂靠、承包关系情形;4、出租、出借、融资租赁情形;5、质权、保管情形;6、被盗用车辆发生交通事故情形;7、好意同乘情形;8、雇佣关系情形。这八种情况也是社会生活经常出现的。
[Abstract]:From the legislative development of motor vehicle damage compensation in the world since twentieth Century, it is very important to study the subject of compensation liability for motor vehicle accidents, and it is also a headache for the legislator. After the reform and opening up, with the development of the socialist market economy in China, consumers buy it. The increase of motor vehicle capacity leads to the increasing rate of motor vehicle increase. At the same time, because of the traffic accidents of motor vehicles, it has caused great personal injury and property loss to the masses of the people. Thus the compensation dispute of motor vehicle traffic accident damage has become a serious social problem that needs to be solved urgently. The damage to motor vehicle accidents is damaged. In the indemnity, the identification of the subject of responsibility presents the characteristics of diversity and complexity. In practice, the right to use the motor vehicle, the right to control and the right of income is very wide. The main body of the liability can be a registered owner or a real manager of a motor vehicle, or a pledge of a motor vehicle, a lessee, a borrower, and a person. People, in individual cases, may be robbers, car robbers and so on. At the same time, in traffic accidents are often hurt by natural people, belonging to relatively vulnerable groups. In order to ensure that the victims get better and faster relief, we must clarify the compensation liability subject in different legal relations. At present, in China, about motor vehicle traffic affairs. Therefore, the legislative provisions of the main body of liability for damages are confused and the judicial practice in various places is not unified. This brings great difficulties to the judicial practice. This paper aims to discuss some theoretical problems of the main body of liability for damage compensation for motor vehicle accidents, and emphatically discusses the dominant position and transport in the theoretical circles at present. In line with the introduction of the theory of revenue, the article makes a typological analysis of the special cases of liability identification of damages. In addition to the introduction, this article is divided into four chapters.
Introduction: it mainly expounds the legal significance of determining the liability of motor vehicle traffic accident damages.
Chapter 1: overview of liability for motor vehicle traffic accident damages
This chapter mainly discusses the concept of the main body of liability for vehicle traffic accident damage compensation, and also makes a distinction between the main body of compensation liability for motor vehicle accident damage and the concept of road traffic accident liability subject.
The second chapter: the identification standard and the liability principle of the liability subject of motor vehicle traffic accident damages.
The criteria for determining the liability subject of liability for traffic accident damage have three kinds of responsibility in theory: the theory of risk sharing, the theory of liability for compensation, the theory of dangerous responsibility. In the principle of imputation, it not only introduces the historical changes of the principle of imputation, but also explains the views of different scholars on this issue. The doctrine of responsibility and the principle of mixed liability.
The third chapter is about the legislative status of the liability subject of motor vehicle traffic accident damages in China.
Introduce the general rules of the civil law, the road traffic accident treatment, the road traffic safety law, the tort liability law, the contract law, and other laws and regulations, and the relevant provisions of the main body of liability for motor vehicle accident damage compensation.
The fourth chapter: the classification of liability subject of motor vehicle traffic accident damages.
Because the social relations are becoming more and more complicated now, the subject of liability subject to the compensation cases of motor vehicle accident damages has the characteristics of complexity and universality. Limited to the limited space, in the fourth part of the article, the main body of compensation for eight special types of vehicle traffic accident damage mainly include: 1, the non transfer machine. Car ownership registration situation; 2, the instalment sale situation; 3, affiliation, contract relationship situation; 4, rent, loan, financial leasing situation; 5, the pledge, the custody situation; 6, the stolen vehicle accident situation; 7, the good intention and the same situation; 8, employment relations. These eight cases are also the social life often appears.
