地名变更的行政法规制

【摘要】：地名是一个地方的名片，它承载着一个地方的发展历史；地名变更是一项行政决策，它折射出当地政府的管理智慧。地名变更应是一项复杂的工程，涉及政治、经济、文化的方方面面，包括很多环节；然而如今，，变更地名已成为一些政府常用的欲推动地方发展的手段，盲目无序更名的背后是任性随意的行政决策，这种做法不但违法，而且还损害当地居民的公共利益。如何全面衡量地名的内在价值和文化，小心谨慎地变更地名，保证地名变更的合法性、民主性和科学性，这是管理者应该深思的问题，也是值得研究和讨论的。论文主要包括三个部分的内容。第一部分为“社会转型时期地名变更现象的涌现”，首先对社会转型时期各种地名变更案例进行归纳，选出具有代表性的四种地名变更类型；其次分析地名变更现象涌现的背后动因，从三个方面进行论述。第二部分为“地名变更无序现象的危害”，这部分从地名变更无序现象会导致传统文化的失落、行政决策的专断、公共利益的损害三个危害分析。第三部分为“地名变更的行政法规制”，主要从三个方面进行研究：首先说明地名变更行政法规制的现状，从我国现行有效的地名管理行政法律规范体系进行分析，得出规范地名管理工作的《地名管理条例》是时候该修订和完善；其次研究如何从实体法上进行规制，关注地名变更应该遵循的目的、遵守的原则、尊重的标准；最后研究如何从程序法上进行规制，分别讨论地名变更如何启动、延展和救济，相应的主体和程序该如何规范。
[Abstract]:Place name is the business card of a place, it bears the development history of a place, and the change of place name is an administrative decision, which reflects the management wisdom of the local government. Change of place names should be a complex project involving all aspects of politics, economy and culture, including many links; however, nowadays, change of place names has become a commonly used means of promoting local development by some governments. Behind the blind and disorderly change of name is arbitrary administrative decision, which not only violates the law, but also harms the public interest of the local residents. How to comprehensively measure the intrinsic value and culture of place names, change place names carefully and ensure the legitimacy, democracy and science of place names change is a problem that managers should ponder over and be worth studying and discussing. The paper mainly includes three parts. The first part is "the emergence of the phenomenon of place name change in the period of social transition". Firstly, the paper sums up various cases of place name change in the period of social transition, and selects four representative change types of place name; Secondly, it analyzes the reasons behind the emergence of the change of place names and discusses it from three aspects. The second part is "the harm of disorderly change of place names", which is analyzed from three aspects: the loss of traditional culture, the arbitrariness of administrative decision and the damage of public interest. The third part is "the administrative regulation system of place name change", mainly from three aspects: first, explain the current situation of the administrative law system of place name change, and analyze from the current effective administrative law system of place name management in our country. It is time to revise and perfect the regulations on the management of geographical names. Secondly, it is necessary to study how to regulate from the substantive law and pay attention to the purposes, principles and standards that should be followed by the change of place names. In the end, it discusses how to start, extend and remedy the change of place names, and how to regulate the subject and procedure.
