天价赔偿案件的再解读

【摘要】：随着我国经济的发展，国民生活水平显著提升，但伴随而来的也有贫富差距拉大等问题。先富人群的大量涌现，拉动了我国整体经济水平，却也使得我国基尼系数屡创新高，天价案件也随之产生。以撞豪车为代表的天价赔偿作为天价案件中的一种，就是在这样的社会背景下产生的。案件本身之所以能够引起诸多讨论，获得大量关注，与本系列案件的高价值标的物、高赔偿额等特征是分不开的。对于这一系列案件的司法裁决也牵动了无数民众的心，引起了广泛的社会影响。许多网民因此发出这样的感慨，，“宁撞公交也不敢撞豪车！”豪车真猛与虎矣！针对这样一种热门现象，笔者试图分析这一系列案件的相关细节，主要就案件的发生始末、后续影响及立法建议给出自己的看法与意见。全文约两万余字，共分为三个章节。文章的第一章节阐述了天价案件与其中所具有代表性的天价赔偿案件的相关概念及几个主要的案件始末，进而通过两者外延的比较以得出对课题研究的现实意义与价值所在。首先就以撞豪车为代表的天价赔偿案件进行基础性的分析，对其产生的社会背景、案件特质、裁判依据及后续反应进行解读。然后在这一基础性分析的基础上，另辟蹊径的在经济分析法学视野下再解读这一案件始末。则是建立在第二部分的分析基础上，给出笔者对于我国后续法制建设的思考与建议。不仅包括了法律思维上的继承与创新，也包含了个人破产制度、豪车配套保险制度等技术层次的制度引入与改造，进而能够使社会能够建立一套适应新时代社会需求的预防及应变机制。以撞豪车案为典型代表的天价赔偿案件是我们在新时代转型时期所遇到的诸多困难中的一种，案件的处理过程也成为了贫富差距拉大后对社会各阶层冲突碰撞解决方式的一次细微展示。
[Abstract]:With the development of China's economy, the standard of living of the people has been improved significantly, but with it the gap between the rich and the poor has widened. The emergence of a large number of rich people, driving the overall economic level of China, but also make our Gini coefficient repeatedly set new records, the price case also emerged. The sky-price compensation as a case of sky-price is produced in such a social background. The reason why the case itself can cause a lot of discussion and get a lot of attention is the characteristics of the high value subject matter and high compensation of this series of cases. The judicial decision on this series of cases also affected the hearts of countless people and caused a wide range of social impacts. Many netizens therefore issued such a feeling, "rather than hit the bus luxury car!" Luxury cars really fierce and tiger! In view of such a hot phenomenon, the author tries to analyze the relevant details of this series of cases, mainly on the occurrence of the case, the follow-up impact and legislative suggestions to give their own views and opinions. The full text about 20,000 words, a total of three chapters. The first chapter of the article expounds the related concepts of the sky-price case and its representative sky-price compensation case and several main cases, and then through the comparison of the extension of the two cases, the practical significance and value of the research on the subject are obtained. First of all, the paper makes a basic analysis on the sky-price compensation case represented by the crash luxury car, and interprets the social background, the characteristics of the case, the basis of the judgment and the follow-up reaction. Then, on the basis of this basic analysis, we try to find a new way to interpret the case from the perspective of economic analysis law. Based on the analysis of the second part, the author gives the author's thoughts and suggestions on the construction of our country's following legal system. Including not only the inheritance and innovation of the legal thinking, but also the introduction and transformation of the system at the technical level, such as the personal bankruptcy system, the matching insurance system for luxury cars, and so on. Thus, the society can establish a set of prevention and contingency mechanism to meet the needs of the new era. The sky-price compensation case, typically represented by the crash of luxury cars, is one of the many difficulties we have encountered in the transition period of the new era. The process of handling the case has also become a subtle demonstration of the conflict resolution of various social strata after the widening gap between the rich and the poor.
