我国失业保险立法问题探析

【摘要】：失业是市场经济条件下产生的一种社会现象,自19世纪末开始,西方主要资本主义国家开始着手涉及失业保险法律制度的构建,迄今为止,世界上已有四十多个国家和地区建立了失业保险制度,同时越来越多的国家也从保障失业者基本生活所需,转向重视失业保险的预防失业和促进就业职能。我国的失业保险制度起步较晚,随着我国改革开放的不断深入,失业问题不断涌现,1999年《失业保险条例》实施,失业保险制度成为社会与法治领域关注的热点话题。经过近十年的发展,2010年我国《社会保险法》以专章立法的形式对我国失业保险法律制度进行了完整的阐释,完善了失业保险制度的法律体系,促进了我国社会保障制度的发展。本文第一部分介绍了失业保险法律制度的基本理论,通过对失业及其相关概念的阐释,为后文展开论述奠定基础。第二部分对我国及国外法治发达国家,如英、美、德、日等国的相关失业保险法律制度进行分析,为我国失业保险法律制度的完善提供了启示。第三部分对我国失业保险法律制度中存在的一系列问题,展开了详尽分析,找出问题的根源,为后文提出解决问题的措施提供相关建议。第四部分针对我国失业保险法律制度中存在的问题提出了解决方案,比如在失业保险领域中关于失业、非自愿性失业、再就业意愿等基础概念的界定问题以及促进再就业、保险基金的筹集、《社会保险法》的完善建议等等,作出了详细的阐释,并结合我国实际国情提出了相关的立法建议。
[Abstract]:Unemployment is a kind of social phenomenon under the condition of market economy. Since the end of the 19th century, the main capitalist countries in the West have begun to involve the construction of the legal system of unemployment insurance. More than 40 countries and regions in the world have established unemployment insurance system. At the same time, more and more countries have shifted from guaranteeing the basic needs of the unemployed to paying attention to the functions of unemployment prevention and employment promotion. The unemployment insurance system of our country starts late. With the deepening of reform and opening up in our country, the unemployment problem emerges constantly. In 1999, the "unemployment Insurance regulations" came into effect, and the unemployment insurance system has become a hot topic in the field of society and the rule of law. After nearly ten years of development, in 2010, the Social Insurance Law of our country made a complete explanation of the legal system of unemployment insurance in the form of special legislation, perfected the legal system of unemployment insurance system, and promoted the development of social security system in China. The first part of this paper introduces the basic theory of the legal system of unemployment insurance, through the explanation of unemployment and its related concepts, it lays a foundation for the later discussion. The second part analyzes the relevant legal systems of unemployment insurance in China and other developed countries, such as Britain, America, Germany, Japan and so on, and provides enlightenment for the perfection of the legal system of unemployment insurance in China. In the third part, a series of problems existing in the legal system of unemployment insurance in China are analyzed in detail to find out the root causes of the problems, and to provide relevant suggestions for the measures to solve the problems later. The fourth part puts forward solutions to the problems existing in the legal system of unemployment insurance in China, such as defining the basic concepts of unemployment, involuntary unemployment, re-employment willingness and promoting re-employment in the field of unemployment insurance. The raising of insurance fund, the perfect suggestion of Social Insurance Law and so on, are explained in detail, and the relevant legislative suggestions are put forward according to the actual situation of our country.
