利益衡平视角下森林生态补偿法律制度研究

【摘要】：法律制度的基本价值在于利益的调整与衡平,森林生态补偿法律制度在于衡平森林生态补偿中各相关主体之间利益失衡的问题。论文以利益衡平为视角贯穿论文的始终,利益的考量是论文绕不开的话题。论文的整个写作流程是按照提出问题-分析问题-解决问题的逻辑思路展开。论文主要分为五个部分,第一部分是文章的绪论,主要针对研究背景和研究意义以及国内外研究现状等问题进行阐述。第二部分主要是对于森林生态补偿制度的法理分析,涉及的相关概念进行界定,包括经济利益与生态利益、资源利益与环境利益、生态补偿和资源有偿使用等相关概念以及生态利益冲突的表现。第三部分是森林生态补偿的基础探究,主要从理论基础、法律基础、实践基础三个层面论述我国森林生态补偿制度的理论基础。第四部分是基于利益衡平的视角来分析和研究我国森林生态补偿制度,目前我国森林生态补偿存在森林生态利益供给不足、森林生态利益分配不均、森林生态补偿利益不合理等社会问题。第五部分经过分析和研究,认为问题我国森林生态补偿制度存在问题的根源在于我国森林生态补偿制度设计背离了法律制度所应具备的四个基本要素(法律制度的确定性、可行性、可预测性、可救济性),难以实现法律制度的利益协调功能。第六部分针对我国森林生态补偿在实践中存在的社会问题,从法律制度应当具备的四个基本要素出发进行制度设计。建议从加强森林生态补偿制度顶层设计,明确利益主体间权利义务关系;充实和完善森林生态补偿内容,确立利益维护与激励机制;渐次推进生态补偿专门立法,加强森林生态补偿法律制度的可预测性;完善生态利益受损救济机制,保障森林生态利益的平衡等方面完善我国的森林生态补偿法律制度。
[Abstract]:The basic value of the legal system lies in the adjustment and balance of interests, and the imbalance of interests among the relevant subjects in the legal system of forest ecological compensation. The thesis runs through the thesis from the angle of interest balance, and the consideration of interest is an inextricable topic. The whole writing process of the thesis is carried out according to the logical thinking of posing problem-analyzing problem-solving problem. The paper is divided into five parts, the first part is the introduction of the article, mainly focusing on the research background and significance, as well as the status quo of research at home and abroad. The second part is mainly about the legal analysis of forest ecological compensation system, including the definition of related concepts, including economic interests and ecological interests, resources interests and environmental interests. Ecological compensation and compensated use of resources and other related concepts as well as ecological conflicts of interest performance. The third part is the basic research of forest ecological compensation, mainly from the theoretical basis, the legal basis, the practical basis of the theoretical basis of forest ecological compensation system in China. The fourth part is to analyze and study the forest ecological compensation system in China based on the perspective of balance of interests. At present, there are insufficient supply of forest ecological benefits and uneven distribution of forest ecological benefits in China's forest ecological compensation. Forest ecological compensation benefits unreasonable and other social problems. The fifth part through the analysis and the research, thinks the question our country forest ecology compensation system existence question root lies in our country forest ecology compensation system design deviates from the legal system should have four basic elements (legal system certainty), Feasibility, predictability, relief, it is difficult to achieve the benefit coordination function of the legal system. The sixth part aims at the social problems existing in the practice of forest ecological compensation in our country and designs the system from the four basic elements that should be possessed in the legal system. It is suggested to strengthen the top-level design of forest ecological compensation system, to clarify the relationship between rights and obligations among the stakeholders, to enrich and perfect the forest ecological compensation content, to establish the interest maintenance and incentive mechanism, and to gradually promote the special legislation on ecological compensation. Strengthening the predictability of the legal system of forest ecological compensation, perfecting the relief mechanism for the damage of ecological interests, ensuring the balance of forest ecological interests, and so on, perfecting the legal system of forest ecological compensation in China.
