【摘要】：随着我国行政体制改革的发展,行政问责制由“风暴”问责转向常态问责,从行政性问责转向程序性问责。公民参与行政问责作为行政问责制度的重要组成部分,虽然已在实践领域中得到越来越多地运用,但目前仍然存在研究理论不足、法律规定不完善、程序规范缺乏等问题。本文试从公民参与行政问责的程序构建入手,采用文献分析法、比较分析法和系统分析法,阐述了我国公民参与行政问责程序方面所面临的现状和困境,在借鉴外国有关公民参与行政问责程序建设经验的基础上,结合我国的实践发展,提出进一步完善我国公民参与行政问责程序的建议,促进公民有效参与行政问责的法治化、规范化、制度化发展。本文主要结构内容包括：第一部分：介绍公民参与行政问责程序基本概述。分为两个方面：一是公民参与行政问责程序基本涵义,包括公民参与行政问责程序的定义及程序；二是强调完善公民参与行政问责程序的意义：有利于保障公民问责权利的实现、有利于规范公民参与行政问责行为、有利于提高公民参与行政问责效能。第二部分：剖析我国公民参与行政问责程序的现状。主要包括三个方面：是阐述我国法律法规关于行政问责的规定,尤其是程序方面的规定；二是介绍我国公民参与行政问责传统方式和网络方式的实践发展；三是归纳公民参与行政问责程序的现实困境：法律规定不健全,环节设置不合理,信息公开不到位,救济机制不完善等。第三部分：完善我国公民参与行政问责程序的建议。该部分涉及三个方面内容：一是公民参与行政问责制的域外经验,分析美国、法国及德国关于公民参与行政问责听证制度、程序立法、机构建设及救济途径等方面的经验。二是提出完善我国公民参与行政问责程序遵循的指导原则：程序正当原则、广泛参与原则、公平公开原则、高效廉洁原则。三是完善我国公民参与行政问责程序的建议：建立健全法律法规及配套制度；完善关键环节和程序设置；全程实行信息公开；健全问责救济程序。
[Abstract]:With the development of China's administrative system reform, the administrative accountability system changes from "storm" accountability to normal accountability, from administrative accountability to procedural accountability. Citizen participation in administrative accountability as an important part of the administrative accountability system, although it has been used more and more in practice, but there are still some problems such as inadequate research theory, imperfect legal provisions, lack of procedural norms and so on. This paper tries to start with the procedure construction of citizen participation in administrative accountability, using the methods of literature analysis, comparative analysis and system analysis, to expound the present situation and predicament of citizen participation in administrative accountability procedure in China. On the basis of drawing lessons from the experience of foreign citizens in the construction of administrative accountability procedure and combining the practical development of our country, this paper puts forward some suggestions to further improve the procedure of citizen participation in administrative accountability, and to promote the effective participation of citizens in the rule of law of administrative accountability. Standardized, institutionalized development. The main structure of this paper includes: the first part: introduce the basic outline of citizen participation administrative accountability procedure. It is divided into two aspects: one is the basic meaning of citizen participation in administrative accountability procedure, including the definition and procedure of citizen participation in administrative accountability procedure; Second, it emphasizes the significance of perfecting citizen's participation in administrative accountability procedure: it is beneficial to the realization of citizen's right to accountability, to standardizing citizen's participation in administrative accountability, and to improving the efficiency of citizen's participation in administrative accountability. The second part: analyze the current situation of citizen's participation in administrative accountability procedure in our country. It mainly includes three aspects: expounding the regulation of administrative accountability in laws and regulations of our country, especially the stipulation of procedure, introducing the practice and development of traditional way and network way of citizen participating in administrative accountability in our country; The third is to sum up the realistic predicament of citizen's participation in administrative accountability procedure: the legal provisions are not perfect, the link setting is unreasonable, the information disclosure is not in place, the relief mechanism is not perfect and so on. The third part: the suggestion of perfecting the procedure of citizen participation in administrative accountability. This part involves three aspects: first, the extraterritorial experience of citizen participation in the administrative accountability system, the analysis of the United States, France and Germany on citizen participation in administrative accountability hearing system, procedural legislation, institutional construction and relief ways and other aspects of experience. The second is to put forward the guiding principles of perfecting the procedure of citizen participation in administrative accountability: the principle of due process, the principle of extensive participation, the principle of fairness and openness, and the principle of high efficiency and integrity. The third is to improve the procedure of citizen participation in administrative accountability: to establish and improve laws, regulations and supporting systems; to improve the key links and procedures; to implement the whole process of information disclosure; to improve the accountability relief procedures.
